Despite the judgment of the Court of Justice of the European Communities on 10 December 2002 in the C-29/99 case recognizing the competences of the European Atomic Energy Community to legislate in the field of the safety of nuclear installations, the lack of a qualified majority in the Council made it impossible to proceed with the so called "nuclear package" which defined Community basic obligations and general principles in the field of the safety of the nuclear facilities.
In zijn uitspraak van 10 december 2002 in zaak C-29/99 erkende het Hof van Justitie van de Europese Gemeenschappen de bevoegdheid van de Europese Gemeenschap voor Atoomenergie om een wet- en regelgevend kader in te stellen betreffende de veiligheid van kerninstallaties. Desondanks was het, bij gebrek aan een gekwalificeerde meerderheid in de Raad, onmogelijk vooruitgang te boeken met het zogeheten “nucleair pakket” , waarin de fundamentele verplichtingen en algemene beginselen van de Gemeenschap op het gebied van de veiligheid van nucleaire installaties werden vastgesteld.

Welke specifieke procedures heeft de Commissie aangenomen om te verzekeren dat de communautaire basisnormen voor de veiligheid worden gerespecteerd met betrekking tot de nucleaire installaties in La Hague en Sellafield? Hoe gaat de Commissie na of de opwerkingsactiviteiten in deze centrales kunnen leiden tot radioactieve besmetting van het water, de bodem of de lucht van andere lidstaten?

Article 4(1)(a) of the Basic Safety Standards Directive requires, amongst other things, that "operation and decommissioning of any facility of the nuclear fuel cycle" be subject to prior authorisation.
In artikel 4, lid 1, onder a), van de basisnormenrichtlijn is onder andere bepaald dat voorafgaande vergunning vereist is voor de "exploitatie, buitengebruikstelling en ontmanteling van installaties voor de splijtstofcyclus".
