The responsibilities within the European Community should be clearly defined, in particular those of the European Commission and of the European GNSS Supervisory Authority (GSA); The Commission should be fully responsible for the overall management of the programmes as the European GNSS Programme Manager, while Member States should be closely associated with the essential elements of the management of the programme, in particular the work programme and the programme implementation plan and associated financing, through a European GNSS Programmes Committee to be established in accordance with the European Community comitology procedures; The GSA should retain the responsibility for, in particular, technical certification, security accreditation, market preparation and commercialisation of the system, and assist the Commission for all matters related to the execution of the programmes; The European Space Agency (ESA) should act as procurement agent for Galileo, subject to the future agreement between the European Community, represented by the Commission, and the ESA; this agreement, to be submitted to the European GNSS Programmes Committee, should be clear and transparent and define the requirements and control measures to be put in place as well as tendering procedures, including appeal and dispute settlement procedures; The questions relating to the security of the systems should be considered as follows:

Whereas the Treaty of 22 July 1975, amending certain financial provisions of the Treaties establishing the European Communities and of the Treaty establishing a single Council and a single Commission of the European Communities, modified the procedure for giving a discharge to the Commission in respect of the implementation of the general budget of the European Communities; whereas therefore it is appropriate to update the procedure for giving a discharge to the Management Board of the European Centre for the Development of Vocational Training, set up by Regulation (EEC) No 337/75 (4) by reference to the procedure so modified, as set out in Article 206b of the EEC Treaty;
Overwegende dat bij het Verdrag van 22 juli 1975 houdende wijziging van een aantal financiële bepalingen van de Verdragen tot oprichting van de Europese Gemeenschappen en van het Verdrag tot instelling van één Raad en één Commissie welke de Europese Gemeenschappen gemeen heben de procedure volgens welke aan de Commissie kwijting wordt verleend voor de uitvoering van de algemene begroting van de Europese Gemeenschappen is gewijzigd; dat derhalve, rekening houdend met de gewijzigde procedure zoals neergelegd in artikel 206 ter van het EEG-Verdrag, de procedure volgens welke aan de Raad van Bestuur van het bij Verordening (EEG) nr. 337/75 (4) ingestelde Europees Centrum voor de ontwikkeling van de beroepsopleiding kwijting wordt verleend, moet worden aangepast;

The new system is designed to bring Community authorisation procedures more closely into line with international obligations under bilateral fisheries agreements and multilateral agreements and conventions adopted in the context of regional fisheries management organisations.
Voorts wordt met het stelsel beoogd om beter aan te sluiten bij de doelstellingen van het gemeenschappelijk visserijbeleid van de EU, met name wat betreft de duurzame visserij en de controle.

In accordance with that code the Regulation will oblige shipping companies to set up a "Safety Management System" under which they would: - establish a policy for the safe operation of its ships and the protection of the environment, - define the responsibilities of, and relations between, all persons responsible within the company and on board the ships for the safe operation of the ships and for pollution prevention, - designate a central person responsible for safe management and pollution prevention, - ensure that the safety personnel ashore, the masters of its ships and the crew are properly qualified and able to communicate with each other on safety matters, - define shorebound and on board instructions, procedures and drills for the safe operation of the ships and for the response to emergency situations, - prepare procedures for the reporting and analysis of non-conformities, accidents and hazardous situations, - ensure proper maintenance of its ships and its equipment, - establish a "Safety Management Manual", - regularly evaluate the SMS, - obtain a "Document of Compliance" issued by the flag State or by the country of operation and certifying that the SMS of the company complies with the ISM-Code, - obtain a "Safety Management Certificate" issued by the flag State and certifying that the SMS of the ship complies with the ISM-Code.
