(10) Whereas the Scientific Committee on Cosmetology was consulted on the safety of certain bovine products on 11 April 1996; whereas the Liaison Committee of European Associations of the Perfume, Cosmetic Products and Toiletries Industries (Colipa) has recommended its members not to use source materials from United Kingdom bovine animals; whereas that Committee has declared that its members follow that recommendation; whereas Commission Directive 97/1/EC of 10 January 1997 adapting to technical progress Annexes II, III, VI, and VII to Council Directive 76/768/EEC on the approximation of the laws of the Member States relating to cosmetic products (9), has provisionally prohibited the placing on the market of cosmetic products containing certain tissues and fluids;

(13) Whereas subsequently, additional information was made available in order to facilitate a more complete risk assessment; whereas, on that basis, the Scientific Veterinary Committee on 26 April 1996 concluded that a combination of appropriate sourcing of bovine materials used and the application of minimum processing standards which have been shown effectively to inactivate the BSE agent together give good reassurances about the safety of those materials for food or cosmetic use; whereas, consequently, the Scientific Veterinary Committee has recommended safety parameters for the production of those materials which are therefore considered to be safe;
(13) Overwegende dat nadien bijkomende gegevens beschikbaar zijn gekomen die een vollediger risico-evaluatie mogelijk hebben gemaakt; dat het Wetenschappelijk Veterinair Comité op 26 april 1996 op grond daarvan tot de bevinding is gekomen dat, wanneer bij de aanschaf van runderen afkomstig materiaal nauwlettend op de oorsprong ervan wordt toegezien en bovendien bij verwerking minimumnormen worden toegepast die voor de inactivering van het BSE-agens doeltreffend zijn gebleken, deze elementen samen goede garanties bieden voor de veiligheid van dit materiaal voor levensmiddelen of voor cosmetica; dat het Wetenschappelijk Veterinair Comité vervolgens voor de vervaardiging van dit materiaal veiligheidsparameters heeft aanbevolen en dat dit materiaal bijgevolg veilig wordt geacht;

(19) Whereas Decision 96/362/EC laid down certain preconditions which had to be met before the United Kingdom could dispatch from its territory gelatin made from raw materials from bovine animals; whereas those preconditions have not been fulfilled and such dispatch has not been authorised; whereas, however, in order to regularise the situation, pending further scientific knowledge and advice, it is appropriate to withdraw the possibility of dispatch of gelatin made from raw materials from bovine animals slaughtered in the United Kingdom for human food, animal feed, cosmetics pharmaceutical and medical purposes; whereas that is in conformity with the advice from the Multidisciplinary Scientific Committee of 3 April 1997, according to which no production can be considered safe if the base material used for gelatin production is potentially infectious;
(19) Overwegende dat bij Beschikking 96/362/EG een aantal voorafgaande voorwaarden zijn vastgelegd waaraan moest worden voldaan alvorens het Verenigd Koninkrijk gelatine vervaardigd uit van runderen afkomstige grondstoffen vanaf zijn grondgebied mocht verzenden; dat aan deze voorafgaande voorwaarden niet is voldaan en bedoelde verzending niet is toegestaan; dat het evenwel, om de situatie te regulariseren, in afwachting van verdere wetenschappelijke kennis en verder advies, raadzaam is de mogelijkheid van verzending van gelatine die uit grondstoffen van in het Verenigd Koninkrijk geslachte runderen is vervaardigd, voor gebruik in levensmiddelen, in diervoeders, en voor cosmetische, farmaceutische en medische doeleinden, in te trekken; dat zulks in overeenstemming is met het advies van het Multidisciplinair Wetenschappelijk Comité van 3 april 1997 volgens hetwelk geen enkele productie veilig kan worden geacht indien de grondstof voor de vervaardiging van gelatine potentieel infectueus is;
