Having regard to Decision No 1/2005 of 8 March 2005 of the ACP-EU Council of Ministers concerning the adoption of the Rules of Procedure of the ACP-EU Council of Ministers (4) and, in particular, Article 8(2) thereof,

In accordance with its Rules of Procedure (3), the ACP-EU Council of Ministers established under the ACP-EU Agreement may approve a request for accession by written procedure,

Article 94 of the revised ACP-EU Agreement stipulates that any request for accession by a State shall be presented to, and approved by, the ACP-EU Council of Ministers.

The Commission notified to the ACP Council of Ministers the increase of the 9th EDF intra-ACP allocation by EUR 24 million and proposed that these resources be used for a contribution to an ACP-EU Water Facility.

By letter of 25 April 2001 the Commission forwarded to Parliament its Communication on the proposal for a Council decision on the adoption of the position of the Community within the ACP-EC Council of Ministers regarding the settlement of all ACP HIPC LDCs’ special loans remaining after full application of HIPC debt alleviation mechanisms (COM(2001) 210 – 2001/2158(COS)).
Bij schrijven van 25 april 2001 deed de Commissie haar mededeling over het voorstel voor een besluit van de Raad tot vaststelling van het standpunt van de Gemeenschap in de ACS-EG-Raad van Ministers betreffende de vereffening van alle aan de minst ontwikkelde ACS-landen met een zware schuldenlast verstrekte speciale leningen die resteren na volledige toepassing van de HIPC-mechanismen voor schuldenlastverlichting (COM(2001) 210 – 2001/2158(COS)) toekomen aan het Parlement.

Furthermore, the ACP Council of Ministers has expressed its concern at what is becoming a habit on the Commission’s part, namely awarding unassigned EDF Funds without consulting the ACP Group and without taking into account the rules governing the decision-making process.
Daarnaast heeft de ACS-Raad van ministers er zijn verontrusting over uitgesproken dat de Commissie er een gewoonte van lijkt te maken nog niet toegewezen EOF-middelen toe te kennen zonder de ACS-groep te raadplegen en rekening te houden met de vigerende besluitvormingsprocedure.

In any event, implementation of the proposed measure requires authorisation from the ACP, since there are 60 million euros’ worth of EDF funds involved – although it may be inferred from the discussions which took place during the 6 December ACP Council of Ministers meeting that the Commission has already implemented the decision without awaiting the joint decision.
Hoe dan ook is voor de uitvoering van de voorgestelde maatregel de goedkeuring van de ACS-landen noodzakelijk, aangezien er EOF-middelen (ten bedrage van 60 mln.) in het geding zijn. Uit de discussies tijdens de ACS-Raad van ministers op 6 december kan worden opgemaakt dat de Commissie reeds een begin heeft gemaakt met de uitvoering van het besluit zonder het gezamenlijke besluit af te wachten.
