The position to be adopted by the European Union within the Association Council, set up by the Agreement establishing an Association between the European Union and its Member States, on the one part, and Central America, on the other part, as regards the adoption of the Rules of Procedure of the Association Council and those of the Association Committee, the Rules of Procedure governing Dispute Settlement under Title X and the Code of Conduct for members of panels and mediators, the list of panellists as well as the list of Trade and Sustainable Development experts shall be based on the draft decisions of the Association Council annexed to this Decision.
Het standpunt dat door de Europese Unie zal worden ingenomen in de Associatieraad die is ingesteld bij de Associatieovereenkomst tussen de Europese Unie en haar lidstaten, enerzijds, en Midden-Amerika, anderzijds, wat betreft de vaststelling van de reglementen van orde van de Associatieraad en van het Associatiecomité, het reglement van orde voor de beslechting van geschillen krachtens titel X en de gedragscode voor leden van de panels en bemiddelaars, de lijst van panelleden en de lijst van deskundigen op het gebied van handel en duurzame ontwikkeling, wordt gebaseerd op de aan dit besluit gehechte ontwerpbesluiten van de Associatieraad.

(a) Vertical agreements entered into between an association of undertakings and its members, or between such an association and its suppliers, only if all its members are distributors of motor vehicles or spare parts for motor vehicles or repairers and if no individual member of the association, together with its connected undertakings, has a total annual turnover exceeding EUR 50 million; vertical agreements entered into by such associations shall be covered by this Regulation without prejudice to the application of Article 81 to horizontal agreements concluded between the members of the association or decisions adopted by the association;
a) verticale overeenkomsten gesloten tussen een ondernemersvereniging en haar leden, of tussen een dergelijke vereniging en haar leveranciers, alleen indien al haar leden distributeurs van motorvoertuigen of reserveonderdelen voor motorvoertuigen of herstellers zijn en mits geen individueel lid van de vereniging tezamen met de met dat lid verbonden ondernemingen een totale jaaromzet van meer dan 50 miljoen EUR behaalt; door dergelijke verenigingen gesloten verticale overeenkomsten vallen binnen het toepassingsgebied van de onderhavige verordening onverminderd de toepassing van artikel 81 op tussen de leden van de vereniging gesloten horizontale overeenkomsten of op door de vereniging genomen besluiten;

The exemption provided for in paragraph 1 shall apply to vertical agreements entered into between an association of undertakings and its members, or between such an association and its suppliers, only if all its members are retailers of goods and if no individual member of the association, together with its connected undertakings, has a total annual turnover exceeding EUR 50 million; vertical agreements entered into by such associations shall be covered by this Regulation without prejudice to the application of Article 81 to horizontal agreements concluded between the members of the association or decisions adopted by the association.
2. De in lid 1 voorziene vrijstelling is van toepassing op verticale overeenkomsten gesloten tussen een ondernemersvereniging en haar leden, of tussen een dergelijke vereniging en haar leveranciers, alleen indien al haar leden detailhandelaren van goederen zijn en mits geen individueel lid van de vereniging tezamen met de met dat lid verbonden ondernemingen een totale jaaromzet van meer dan 50 miljoen EUR behaalt. Door dergelijke ondernemersverenigingen gesloten verticale overeenkomsten vallen binnen de toepassing van de onderhavige verordening zonder afbreuk te doen aan de toepassing van artikel 81 van het Verdrag op tussen de leden van de vereniging gesloten horizontale overeenkomsten of op door de vereniging genomen besluiten.

Whereas the nature of the information and of the checks necessary for the application of Article 65 requires that notification of such decisions to the association itself should be effective as notification to all the member undertakings ; whereas the first paragraph of Article 48 expressly provides that the activities of the association must not be contrary to the provisions of the Treaty or to the decisions or recommendations of the High Authority ; whereas Article 65 (1) not only forbids undertakings to conclude agreements that may restrict competition, but also forbids associations of undertakings to take decisions having the like effect ; whereas it follows that all undertakings belonging to an association must bear responsibility for the actions of that association ; whereas this manner of notification could not be prejudicial to undertakings in view of the fact that they cannot by forming associations escape the obligations devolving upon them under the Treaty ; whereas, moreover, the legal safeguards afforded to undertakings by the Treaty and in particular the application of Article 36 thereof not affected by this manner of notification;
Overwegende dat de aard van de in verband met de toepassing van artikel 65 noodzakelijke inlichtingen en verificaties vereist dat dergelijke beschikkingen ook voor de betrokken ondernemingen bindend zijn indien deze ter kennis worden gebracht van de vereniging waartoe zij behoren; dat in artikel 48, eerste alinea, uitdrukkelijk is bepaald dat de werkzaamheden van de verenigingen niet strijdig mogen zijn met de bepalingen van het Verdrag of met de beschikkingen of aanbevelingen van de Hoge Autoriteit; dat bij artikel 65, lid 1, niet alleen de ondernemingen wordt verboden om overeenkomsten te sluiten welke kunnen leiden tot beperking van de mededinging, maar dat eveneens de verenigingen van ondernemingen wordt verboden om soortgelijke besluiten te nemen; dat daaruit volgt dat elke onderneming die zich bij een vereniging aansluit verantwoordelijk is voor de handelingen van deze vereniging; dat de ondernemingen door deze wijze van kennisgeving niet worden benadeeld, aangezien zij zich door het vormen van verenigingen niet kunnen onttrekken aan de hun krachtens het Verdrag opgelegde verplichtingen; dat overigens de door het Verdrag aan de ondernemingen verleende rechtsbescherming, en in het bijzonder de toepassing van artikel 36 van het Verdrag, door deze wijze van kennisgeving niet wordt aangetast;
