TRADUCTIONS EN CONTEXTE

This Framework Decision is the first important step in European Union law on prevention of conflicts of jurisdiction.[3] In the context of the internationalisation of crime within the European Union, this measure provides added value by improving the proper functioning of the European area of justice.
Het kaderbesluit is de eerste belangrijke stap op het gebied van de EU-wetgeving inzake het voorkomen van jurisdictiegeschillen.[3] In de context van de internationalisering van de criminaliteit binnen de Europese Unie biedt deze maatregel een meerwaarde door de werking van de Europese rechtsruimte te verbeteren.

European Union law must be interpreted as meaning that it is for the Member States to define the concept of ‘workers who have an employment contract or an employment relationship’ in Clause 2.1 of the Framework Agreement on part-time work concluded on 6 June 1997 which appears in the Annex to Council Directive 97/81/EC of 15 December 1997 concerning the Framework Agreement on part-time work concluded by UNICE, CEEP and the ETUC, as amended by Council Directive 98/23/EC of 7 April 1998, and, in particular, to determine whether judges fall within that concept, subject to the condition that that does not lead to the arbitrary exclusion of that category of persons from the protection offered by Directive 97/81, as amended by Directive 98/23, and that agreement.
Het Unierecht moet in die zin worden uitgelegd dat het aan de lidstaten staat om het begrip „werkers die werken uit hoofde van een arbeidsovereenkomst of een arbeidsverhouding” in clausule 2, punt 1, van de op 6 juni 1997 gesloten raamovereenkomst inzake deeltijdarbeid, die is opgenomen in de bijlage bij richtlijn 97/81/EG van de Raad van 15 december 1997 betreffende de door de Unice, het CEEP en het EVV gesloten raamovereenkomst inzake deeltijdarbeid, zoals gewijzigd bij richtlijn 98/23/EG van de Raad van 7 april 1998, te definiëren, en met name te bepalen of rechters onder dit begrip vallen, op voorwaarde dat dit er niet toe leidt dat deze categorie van personen willekeurig wordt uitgesloten van de bij richtlijn 97/81, zoals gewijzigd bij richtlijn 98/23, en die raamovereenkomst verleende bescherming.

The Treaty thus recognizes the importance of the financial framework as a cornerstone of the budgetary architecture of the European Union and finally encodes this successful practice into the system of European Union law.
In het Verdrag wordt dus het belang erkend van het financieel kader als een hoeksteun van de budgettaire structuur van de Europese Unie en wordt deze succesvolle praktijk eindelijk in het rechtstelsel van de Europese Unie opgenomen.

European legal acts are simplified and their terminology is clarified, using more understandable vocabulary: "European laws" and "European framework laws" replace the existing multiple types of act (regulations, directives, decisions, framework decisions, etc);

1.26 considers the conferral of competences to the European Union in the trade in culture, education, health and social services needs close monitoring of compliance with the principles of subsidiarity and proportionality and recommends that the Commission generally makes use of European framework laws leaving national, regional and local authorities the choice of form and methods in achieving the desired results.
1.26 Bij de toewijzing van bevoegdheden inzake de handel in cultuur, onderwijs, volksgezondheid en sociale dienstverlening aan de EU moet nauwgezet in de gaten worden gehouden of de beginselen van subsidiariteit en evenredigheid in acht worden genomen. Het CvdR beveelt aan dat de Commissie in principe gebruikmaakt van Europese kaderwetgeving, zodat nationale, regionale en lokale overheden zelf kunnen kiezen hoe zij de beoogde doelstellingen willen bereiken.

1.25 takes note of the inclusion of supporting, coordinating or complementary action at Union level in the areas of sport [Article III-282], tourism [Article III-281] and civil protection [Article III-284], where local and regional authorities have important roles and calls on the Commission to generally make use of European framework laws;
1.25 Het stelt vast dat de Unie voortaan ook ondersteunende, coöordinerende en aanvullende maatregelen kan treffen inzake sport [Artikel III-282], toerisme [Artikel III-281] en civiele bescherming [Artikel III-284], gebieden waarop lokale en regionale overheden belangrijke taken vervullen. Het verzoekt de Commissie om in principe gebruik te maken van Europese kaderwetgeving.

The Council, acting unanimously after obtaining the consent of the European Parliament, may adopt a European decision identifying other areas of crime. Article III-172 provides that "European framework laws may establish minimum rules concerning the definition of criminal offences and sanctions in the areas of particularly serious crime with cross-border dimensions resulting from the nature or impact of such offences or from a special need to combat them on a common basis".

If the approximation of criminal legislation proves essential to ensure the effective implementation of a Union policy in an area which has been subject to harmonisation measures, European framework laws may establish minimum rules with regard to the definition of criminal offences and sanctions in the area concerned (Article III-172(2)).
Indien onderlinge aanpassing van het strafrecht nodig blijkt voor een doeltreffende uitvoering van beleid van de Unie op een gebied waarop harmonisatiemaatregelen zijn vastgesteld, kunnen bij Europese kaderwet minimumvoorschriften worden vastgesteld met betrekking tot de bepaling van strafbare feiten en de sancties op het betrokken gebied (zie artikel III-172, lid 2).
