Since the objective of this Regulation, namely to contribute to the institutional, administrative and structural reforms in Member States by providing support to national authorities, as defined in this Regulation, for measures aimed at reforming institutions, governance structures or public administration and economic and social sectors, including through assistance for the efficient, transparent and effective use of the Union funds, cannot be sufficiently achieved by the Member States, but can rather, by reasons of its scale and effects, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

As a result, the MoU has been updated in the areas of financial sector reform, fiscal policy and structural reforms, in particular with regard to (i) a roadmap for the gradual relaxation of capital controls, (ii) establishing the legal framework for a new governance structure to manage the stake of the State in the cooperative credit sector, (iii) an anti-money laundering action plan, (iv) a compensation scheme for provident funds and retirement funds which held deposits at the Cyprus Popular Bank, (v) ensuring that the necessary national funds remain available to cover national contributions for projects funded by the Structural and other EU funds, (vi) providing details of the planned reform of public assistance, and (vii) preparing detailed policy proposals for activation policies and taking swift action to create opportunities for young people and improve their employability prospects.

STRESSES the importance of the following principles in the way forward on T2S: T2S should be open to non-euro area Central Securities Depositories and currencies, subject to agreement between the concerned parties; The existing securities settlement systems as they are currently operated, either interfaced or integrated, should not be put into question during the migration phase until T2S is implemented; thus the migration phase should be competitively neutral; The governance structure, for the development and the future operation of T2S respectively, should provide solutions for the handling of potential conflicts of interest (to that effect a separate legal entity could be considered as a way of distinguishing between the operation and supervision of the system); The governance structure should adequately involve all affected market participants from across the EU and ensure responsiveness to market needs and provide for accountability and transparency; The supervisory arrangements applying to Central Securities Depositories should remain safe and efficient, and the implications of T2S for these arrangements should therefore be analysed to that end; The legal implications of reconciling T2S with existing national jurisdictions should be clearly analysed; The technical specifications should enable both direct and indirect holdings of securities in T2S, with the same efficiency and costs.
