In the light of the foregoing considerations, the third ground of appeal must be upheld and, on that basis, the judgment under appeal must be set aside, without it being necessary to consider the other two grounds of appeal.

In the light of all (of) the foregoing considerations, it must be concluded that, by taking the view that the trade mark applied for was devoid of any distinctive character, the Board of Appeal misconstrued the wording of Article 7(1)(b) of Regulation No 40/94 from which it follows that a minimum degree of distinctive character is sufficient to render inapplicable the ground for refusal set out in that article (Case T-34/00 Eurocool Logistik v OHIM (EUROCOOL) [2002] ECR II‑683, paragraph 39.Grille, paragraphs 33 and 49; and Shape of a bottle, paragraph 42).
Gelet op een en ander dient te worden geconcludeerd dat de kamer van beroep, door te oordelen dat het aangevraagde merk elk onderscheidend vermogen mist, een verkeerde uitlegging heeft gegeven aan de bewoordingen van artikel 7, lid 1, sub b, van verordening nr. 40/94, waaruit voortvloeit dat een minimaal onderscheidend vermogen voldoende is om de in deze bepaling genoemde weigeringsgrond uit te sluiten [arresten Gerecht van 27 februari 2002, Eurocool Logistik/BHIM (EUROCOOL), T‑34/00, Jurispr. blz. II‑683, punt 39; Grille, reeds aangehaald, punten 33 en 49, en Vorm van fles, reeds aangehaald, punt 42].

At all events, any decision not to grant approval could be appealed against on grounds of ultra vires before the administrative courts, which would give judgment in the light of the grounds for such refusal.
