5. Notwithstanding paragraph 2, where a Community-scale group of undertakings within the meaning of Article 2(1)(c) comprises one or more undertakings or groups of undertakings which are Community-scale undertakings or Community-scale groups of undertakings within the meaning of Article 2(1)(a) or (c), a European Works Council shall be established at the level of the group unless the agreements referred to in Article 6 provide otherwise.
5. 6. Unless a wider scope is provided for in the agreements referred to in Article 6, the powers and competence of European Works Councils and the scope of information and consultation procedures established to achieve the purpose specified in paragraph 1 shall, in the case of a Community-scale undertaking, cover all the establishments located within the Member States and, in the case of a Community-scale group of undertakings, all group undertakings located within the Member States.
6. Tenzij in de in artikel 6 bedoelde overeenkomsten in een ruimer toepassingsgebied is voorzien, strekken de rechten en bevoegdheden van de Europese ondernemingsraden en procedures voor de informatie en raadpleging van de werknemers die zijn ingesteld om de doelstelling van lid 1 te verwezenlijken zich bij een onderneming met een communautaire dimensie uit tot alle in de lidstaten gelegen vestigingen en bij een concern met een communautaire dimensie tot alle in de lidstaten gelegen ondernemingen van het concern.

On examining the proposal for a directive of the European Parliament and of the Council to recast Council Directive 94/45/EC of 22 September 1994 on the establishment of the European Works Council or a procedure in Community-scale undertakings and Community-scale groups for the purposes of informing and consulting employees, the Working Party established, by common consent, that additions were to be made to the text of the correlation table in Annex III of the proposal to recast.

The information and consultation of the European Works Council shall relate in particular to the structure, economic and financial situation, probable development and production and sales of the Community-scale undertaking or group of undertakings, the situation and probable trend of employment, investments, and substantial changes concerning organisation, introduction of new working methods or production processes, transfers of production, mergers, cut-backs or closures of undertakings, establishments or important parts thereof, and collective redundancies.
