(15) Since the objective of this Directive, namely to facilitate the creation of Union-wide information products and services based on public sector documents, to ensure the effective cross-border use of public sector documents on the one hand by private companies, focusing on small and medium enterprises, for added-value information products and services, and on the other hand by citizens to facilitate the free circulation of information and communication, cannot be sufficiently achieved by Member States and can therefore, in view of the intrinsic pan-European scope of the proposed action, be better achieved at Union level, the Union may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on the Functioning of the European Union.
(15) Daar het doel van deze richtlijn, namelijk het vereenvoudigen van de totstandbrenging van informatieproducten en -diensten op het niveau van de Unie gebaseerd op overheidsdocumenten, het zorgen voor doelmatig grensoverschrijdend gebruik van overheidsdocumenten, hetzij door bedrijven, en met name het mkb, voor informatieproducten en -diensten met toegevoegde waarde, hetzij door burgers met het oog op de bevordering van het vrije verkeer van informatie en communicatie, niet op voldoende wijze door de lidstaten kan worden verwezenlijkt en derhalve met het oog op de intrinsieke pan-Europese toepassing van het voorgestelde optreden, beter op het niveau van de Unie kan worden verwezenlijkt, kan de Unie overeenkomstig het in artikel 5 van het Verdrag betreffende de werking van de Europese Unie neergelegde subsidiariteitsbeginsel maatregelen nemen.

Going back to the pre-Schengen era is not an option; after all, the free movement of persons and the effective functioning of the European Union go hand in hand, and the latter is dependent on the former.
Terug naar de tijd van vóór Schengen is geen optie. Het vrij verkeer van personen is nu eenmaal inherent aan en voorwaarde voor een goed functioneren van de Europese Unie.

Furthermore, the Commission would like to remind the honourable Member that it adopted a proposal on passenger car related taxes on 5th July 2005, which includes a number of measures designed, on the one hand, to improve the functioning of the Internal Market by eliminating certain fiscal obstacles to the free movement of passenger cars in the EU and, on the other hand, to restructure the tax bases of car related taxes in order to include a carbon dioxide sensitive element.
Voorts zou de Commissie de geachte afgevaardigde opmerkzaam willen maken op het voorstel inzake belastingen op personenauto’s dat zij op 5 juli 2005 heeft aangenomen . Daarin is een aantal maatregelen opgenomen die erop gericht zijn, enerzijds, de werking van de interne markt te verbeteren door obstakels van fiscale aard weg te nemen die een belemmering vormen voor het vrij verkeer van personenauto's in de EU en, anderzijds, de belastinggrondslag voor personenauto’s te herstructureren om er een met kooldioxide verband houdende parameter in op te nemen.

(3) Whereas, in order to ensure fulfilment of the obligations arising from the Treaty, and, in particular, to ensure the proper functioning of the internal market, Member States should, on the one hand, abstain from adopting measures or engaging in conduct liable to constitute an obstacle to trade and, on the other hand, take all necessary and proportionate measures with a view to facilitating the free movement of goods in their territory;
(3) Overwegende dat de lidstaten, teneinde de uit het Verdrag voortvloeiende verplichtingen na te komen en, in het bijzonder, de goede werking van de interne markt te waarborgen, zich enerzijds moeten onthouden van maatregelen of gedragingen die het handelsverkeer kunnen belemmeren en anderzijds alle noodzakelijke en evenredige maatregelen moeten treffen om het vrije verkeer van goederen op hun grondgebied te vergemakkelijken;
