Under Articles 55 and 106 of Regulation No 6/2002, an appeal will lie to a Board of Appeal of the OHIM from decisions of the examiners (Article 103 empowers the examiners to take decisions in relation to an application for registration of a Community design), the Administration of Trade Marks and Designs and Legal Division and Invalidity Divisions (responsible under Article 104(2) for taking those decisions which do not fall within the competence of an examiner or an Invalidity Division) and the Invalidity Division (responsible under Article 105 for taking decisions in relation to applications for declarations of invalidity of registered Community designs).
Volgens de artikelen 55 en 106 van Verordening nr. 6/2002 kan tegen beslissingen van onderzoekers in appel worden gegaan bij de Kamer van Beroep van het HBIM (artikel 103 verleent onderzoekers de bevoegdheid om beslissingen te nemen over aanvragen voor registratie van Gemeenschapsmodellen), bij de Afdeling merken-, tekeningen- en modellenadministratie en juridische aangelegenheden (die volgens artikel 104, lid 2 bevoegd is voor besluiten die niet onder de bevoegdheid van een onderzoeker of van een nietigheidsafdeling vallen), en bij de Nietigheidsafdeling (die volgens artikel 105 bevoegd is om beslissingen te nemen over vorderingen tot nietigverklaring van een ingeschreven Gemeenschapsmodel).
