In its judgment given today, the Court states, first of all, that although the contested marks were registered on 31 January 2003 – that is to say, before the regulation entered into force – that regulation is applicable in the present case. In that connection, the Court observes that the retrospective application of the regulation does not undermine the principle of legal certainty or the principle of the protection of legitimate expectations.

Your rapporteur endorses the Commission's intention to bring forward the Regulation's entry into force to 1 April 2005 so that the countries hit by the tsunami can benefit from the advantages offered by the new system as soon as possible. Nevertheless, your rapporteur believes that, in accordance with the principles of legal certainty, sound administration and legitimate trust, a transitional period should be provided until 31 December 2005 so that countries which benefit from the special schemes currently in force under Council Regulation (EC) No 2501/2001 and which are not included in the list of beneficiaries of the new special incentive scheme do not suffer an unjustified erosion of preferences.

WELCOMES the CARS 21 Mid-term review High Level Conference conclusions [8] and stresses that the main principles of the mid-term review should remain the guiding forces for the future decision-making process, while applying thoroughly the better regulation principles, namely through impact assessments, in order to guarantee predictability and legal certainty for the businesses and assess cumulative costs of regulation.
