To a great extent, artists who dazzle us again and again contribute to making our lives complete, whether it be painting, sculpture, literature, song, theatre, graphics, photography, design or even film, which reaches vast masses of people.
In grote mate zijn het de kunstenaars die bijdragen aan een compleet leven door ons steeds opnieuw in vervoering brengen, of het nou gaat om de schilderkunst, beeldhouwkunst, literatuur, zang, theater, grafische vormgeving, fotografie, design of zelfs de filmkunst die grote massa’s bereikt.

Whereas according to different artistic traditions within the Community water-colour, gouache and pastel pictures are variously regarded as being either paintings or drawings; whereas category 4 of the Annex to Regulation No 3911/92 (4) includes drawings executed entirely by hand on any medium in any material and category 3 includes pictures and paintings executed entirely by hand on any medium in any material; whereas the financial thresholds which apply to these two categories are different; whereas in the internal market this could lead to serious differences of treatment for water-colour, gouache and pastel pictures depending upon the Member State in which they are situated; whereas it is necessary to decide for the purposes of the application of the Regulation into which category they shall fall to ensure that the financial thresholds applied shall be the same throughout the Community;
Overwegende dat in overeenstemming met de verschillende kunsttradities binnen de Gemeenschap aquarellen, gouaches en pasteltekeningen hetzij als schilderijen, hetzij als tekeningen worden beschouwd; dat categorie 4 van de bijlage bij Verordening (EEG) nr. 3911/92 (4) tekeningen die geheel met de hand zijn vervaardigd, ongeacht op welke ondergrond en van welke materialen, en categorie 3 afbeeldingen en schilderijen die geheel met de hand zijn vervaardigd, ongeacht op welke ondergrond en van welke materialen, omvat; dat de op deze twee categorieën toepasselijke waardedrempels verschillend zijn; dat deze situatie binnen de interne markt zou kunnen leiden tot ernstige verschillen in de behandeling van aquarellen, gouaches en pasteltekeningen naar gelang van de Lid-staat waar zij zich bevinden; dat het voor de toepassing van de verordening nodig is dat in de gehele Gemeenschap dezelfde waardedrempels worden toegepast en dus moet worden bepaald in welke categorie zij dienen te worden ondergebracht;

- pictures, collages and similar decorative plaques, paintings and drawings, executed entirely by hand by the artist, other than plans and drawings for architectural, engineering, industrial, commercial, topographical or similar purposes, hand-decorated manufactured articles, theatrical scenery, studio back cloths or the like of painted canvas (CN code 9701),
- schilderijen, collages en dergelijke decoratieve platen, schilderijen en tekeningen geheel van de hand van de kunstenaar, met uitzondering van bouwtekeningen en andere tekeningen voor industriële, commerciële, topografische en dergelijke doeleinden en van met de hand versierde voorwerpen alsmede van beschilderd doek voor theatercoulissen, voor achtergronden van studio's of voor dergelijk gebruik (GN-code 9701);

The issues debated by that committee include, in particular, the interpretation of categories A3 and A4 of the Annex concerning respectively pictures and paintings executed entirely by hand and mosaics and drawings by comparison with water-colour, gouache and pastel pictures which, depending on the different artistic traditions and different price levels, were considered either as paintings or as drawings.
Van de door dit Comité onderzochte vraagstukken zij vooral gewezen op die betreffende de interpretatie van de categorieën A3 en A4 van de bijlage, respectievelijk aangaande afbeeldingen en schilderijen die geheel met de hand zijn vervaardigd en mozaïeken en tekeningen: aquarellen, gouaches en pasteltekeningen die namelijk, afhankelijk van de uiteenlopende artistieke tradities en de verschillen in prijs, hetzij als schilderijen hetzij als tekeningen werden beschouwd.
