TRADUCTIONS EN CONTEXTE

The reduced rates of taxation are applicable in geographical areas fulfilling one of the following criteria: (a) most severe climate conditions within the Italian territory, that is communes falling into zone F as defined in the Presidential Decree No 412 of 1993 (3); (b) severe climate conditions combined with difficulties with fuel procurement, that is communes falling into zone E as defined in the Presidential Decree No 412 of 1993; and (c) geographical isolation combined with difficult and costly fuel procurement, that is Sardinia and small islands.

Thus, the tax reduction is applicable in geographical areas (communes) fulfilling the following alternative criteria: (i) communes falling within climate zone F as defined in the Presidential Decree No 412 of 1993 (2), that is communes with more than 3 000‘day degrees’; (ii) communes falling within zone E as defined in the Presidential Decree No 412 of 1993, that is communes with 2 100 to 3 000‘day degrees’ (3); and (iii) Sardinia and small islands (all Italian islands apart from Sicily).

While all shipowners should have complied with this requirement by 31 December 2005, the Greek Government, in Document 1576 of 31 July 2006, put forward a draft presidential decree amending Presidential Decree 374/2002 (Official Gazette 321 A') regarding 'compliance by vessels with the provisions of paragraph 2 of Presidential Decree 400/1996 (Official Gazette 268 A')' and submitted the proposal to the Council of State, which ruled that the proposal regarding a two-year extension of the deadline contained in the draft presidential decree 'had not been tabled through the proper legal channels', revealing that the Greek Government was covering up for shipping companies polluting the marine environment and concealing the dangers to public health.

4. Tender procedure: This tender procedure is subject to the provisions of Article 4(1)(d) and (i) of Council Regulation (EEC) No 2408/92 on access for Community air carriers to intra-Community air routes and to the provisions of Presidential Decree 346/98 aligning Greek legislation on public service contracts with the provisions of Council Directive 92/50/EEC of 18.7.1992, as amended by Presidential Decree 18/2000.
4. 13. Notes with regret that Belarus is no longer one of the target countries of the European Initiative for Democracy and Human Rights (EIDHR 2002-4), as the European Commission has established that the necessary conditions for the implementation of this programme in the recipient country have not been met (in particular as a result of Presidential Decree No 8); also regrets the fact that, for the above reasons, Belarus will not be included in the forthcoming call for proposals under the TACIS Institution Building Partnership Programme (IBPP); calls on the Government of Belarus in particular to revoke without delay Presidential Decree No 8 and to create the conditions that would allow projects cofinanced by the EU to promote democracy and human rights (EIDHR, Tacis IBPP) to be successfully implemented;
13. constateert tot zijn spijt dat Wit-Rusland niet meer tot de doellanden van het Europese Initiatief voor democratie en mensenrechten (EIDHR 2002-4) behoort omdat de EU-Commissie heeft vastgesteld dat het ontvangende land niet voldoet aan de nodige voorwaarden voor de uitvoering van dit programma (met name vanwege het presidentiële decreet nr. 8); betreurt voorts dat om reeds genoemde redenen bij de binnenkort verschijnende oproep voor voorstellen in het kader van het Partnerschapsprogramma voor institutionele opbouw onder Tacis (IBPP) geen rekening is gehouden met Wit-Rusland; verzoekt de Wit-Russische regering om met name het presidentiële decreet nr. 8 onmiddellijk in te trekken en de voorwaarden te scheppen die een succesvolle tenuitvoerlegging van het mede door de EU gefinancierde project in het kader van de ontwikkeling van de democratie en de mensenrechten (EIDHR, TACIS IBPP) mogelijk maken;

Notes the declaration by the Czech Parliament of 24 April 2002 and that of the Government that "no new legal relations can be established" on the basis of the Presidential Decrees; takes note of the joint statement by Prime Minister Zeman and Commissioner Verheugen; expects the Czech Republic if existing Czech law – e.g. on the basis of the Presidential Decrees – still contains discriminatory provisions which run counter to the acquis, to eliminate those provisions at the latest by the time of its accession to the EU; will adopt its final position on this matter taking also into account the external legal opinion requested;
59. neeemt kennis van de verklaring van het Tsjechische parlement van 24 april 2002 en die van de regering dat geen nieuwe juridische relaties kunnen worden aangegaan op basis van de presidientiële decreten; neemt nota van de gezamenlijke verklaring van premier Zeman en commissaris Verheugen; verwacht van Tsjechië dat het in geval de bestaande Tsjechische wetgeving – bijv. op basis van presidentiële decreten – nog discriminerende bepalingen bevat die indruisen tegen het communautaire acquis deze bepalingen uiterlijk op het moment van toetreding tot de EU intrekt; stelt rekening houdend met het gevraagde externe juridische advies zijn definitieve standpunt in deze vast;
