IN-CONTEXT TRANSLATIONS

Regulation (EU) No 1215/2012 applies to proceedings relating to EU trade marks and applications for EU trade marks, as well as to simultaneous and successive actions on the basis of EU and national trade marks.
Verordening (EU) nr. 1215/2012 heeft betrekking op procedures voor EU-merken en de aanvraag van een EU-merk, en ook op gelijktijdige en opeenvolgende procedures op grond van EU- en nationale merken.

1. Unless otherwise specified in this Regulation, the Union rules on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters shall apply to proceedings relating to EU trade marks and applications for EU trade marks, as well as to proceedings relating to simultaneous and successive actions on the basis of EU trade marks and national trade marks.

Tenzij deze verordening anders bepaalt, zijn de regels van de Unie betreffende de rechterlijke bevoegdheid en de erkenning en de tenuitvoerlegging van beslissingen in burgerlijke en handelszaken van toepassing op de procedures betreffende Uniemerken en aanvragen voor Uniemerken, alsmede op de procedures betreffende gelijktijdige en opeenvolgende vorderingen die worden ingesteld op grond van Uniemerken en nationale merken.

The present increase in workload stems from (a) the increase in the number of admissible classes of action; (b) the increase in litigation following the 2004 and 2007 accessions; (c) the litigation engendered by the increase, resulting from greater European integration, in the number and variety of legislative and regulatory acts of the institutions, bodies, offices and agencies of the EU; and (d) the growth of litigation relating to Community trade mark applications.

1. Unless otherwise specified in this Regulation, Regulation (EC) No 44/2001 shall apply to proceedings relating to Community trade marks and applications for Community trade marks, as well as to proceedings relating to simultaneous and successive actions on the basis of Community trade marks and national trade marks.

This implies the replacement of 'Community trade mark' by 'European trade mark'.

However, if one of the parties to the proceedings before the Community trade mark court so requests, the court may, after hearing the other parties to these proceedings, stay the proceedings.
Indien evenwel een van de partijen in de procedure voor de rechtbank voor het Gemeenschapsmerk daarom verzoekt, kan de rechtbank, nadat de andere partijen zijn gehoord, de procedure schorsen.

1) A Community trade mark shall not entitle the proprietor to prohibit its use in relation to goods which have been put on the market in the Community under that trade mark by the proprietor or with his consent.
Het aan het merk verbonden recht staat de houder niet toe het gebruik daarvan te verbieden voor waren die onder dit merk door de houder of met zijn toestemming in de Gemeenschap in de handel zijn gebracht.
