In the case of disputes subject to the proceedings pending before the Opposition Divisions, Cancellation Divisions or before the Boards of Appeal of the Office a joint request for mediation may be presented at any time after the lodging of a notice of opposition, an application for revocation or an application for a declaration of invalidity or a notice of appeal against decisions of the Opposition or Cancellation Divisions.
4. Consequently, in case of counterclaims for revocation, the local or regional division should be given the possibility to refer the counterclaim to the central division and proceed with the infringement claim independently.
Dat betekent dat lokale of regionale afdelingen de mogelijkheid moeten krijgen om reconventionele vorderingen tot intrekking voor een beslissing door te verwijzen naar de centrale afdeling en zelfstandig door te gaan met de behandeling van de inbreukprocedure.

Furthermore if a revocation action is already pending before the central division the patent holder should have the possibility to bring an infringement action to the central division.
