The law was followed by a second Directive on the right to information in criminal proceedings, adopted in 2012 (see IP/12/575), and then by a third Directive on the right to access to a lawyer and on the right to communicate, when deprived of liberty, with third persons and with consular authorities, adopted in 2013 (IP/13/921).

Where the applicant is the right-holder of a Community trademark or a Community design right, a Community plant variety right or a designation of origin or geographical indication or a geographical designation protected by the Community, an application may, in addition to requesting action by the customs authorities of the Member State in which it is lodged, request action by the customs authorities of one or more other Member States.

If national decisions entail that persons who derive rights from Community law in the relevant Member State have to operate under different conditions than competitors or (legal) persons in comparable circumstances elsewhere in the Community, that clearly impinges on the uniformity of Community law, undermines effectiveness and disregards the rights of citizens.

The Immigration Appeal Tribunal, before which the matter has been raised at final instance, has requested the Court of Justice to deliver a preliminary ruling on, inter alia, the following question: can this Community national, on returning to her Member State of origin, claim the right which Community law confers on migrant workers, that is to say, the right for her spouse to settle with her in her Member State of origin, and must her Member State of origin accept that national immigration law cannot apply to her spouse?

It seeks to ensure that suspects and defendants in criminal proceedings enjoy the minimum rights secured in all the Union Member States as regards access to lawyers, interpreters and translators, the right to communicate with consular and other authorities, information on one’s rights and the protection of vulnerable categories.
