In accordance with Article 17(7) of Regulation (EC) No 110/2008, France and several French producers of rum submitted objections to the registration of ‘Ron de Guatemala’ as a geographical indication on the grounds that the specifications of the product and the definition of rum under Guatemalan law, which the technical file refers to, would not be in line with the definition of rum under category 1 of Annex II to that Regulation and with the other requirements of that Regulation, mainly as regards the prohibition to use flavourings, colorants and sweeteners for the production of rum, the rules on the raw materials to be used, on the quality of the water to be added and on the indication of the ageing in the description, presentation or labelling of the product.
Overeenkomstig artikel 17, lid 7, van Verordening (EG) nr. 110/2008 hebben Frankrijk en verschillende Franse rumproducenten bezwaar ingediend tegen de registratie van „Ron de Guatemala” als geografische aanduiding op grond van het feit dat de specificaties van het product en de definitie van rum volgens Guatemalteeks recht, waarnaar het technische dossier verwijst, niet in overeenstemming zouden zijn met de definitie van rum van categorie 1 in bijlage II bij die verordening en met andere bepalingen in die verordening, met name wat betreft het verbod op het gebruik van aroma’s, kleurstoffen en zoetstoffen voor de productie van rum, de regels inzake de gebruikte grondstoffen, inzake de kwaliteit van het water dat moet worden toegevoegd en inzake de aanduiding van de rijping in de aanduiding, de presentatie of de etikettering van het product.

It was with this in mind that the professional bodies representing producers in the French overseas départements and in the Caribbean countries agreed, in October 2006, at La Barbade, on a common position on the Community definition of rum, taking as the basis for it a generic definition and going on to draw progressive distinctions between traditional rum, agricultural rum and rum refined from sugar.

(7a) In order not to create distortion of competition between alcoholic beverages on French territory, and more particularly in relation to rums other than those from FOD, profit made as a result of the application of a reduced rate of excise duty on rum produced in the FOD may not be used for purposes of promotion, but must be invested in full in the restructuring of the cane-sugar-rum sector with a view to ensuring the economic and social balance of the FOD.
(7 bis.) On a market with 28 % growth (average for the period 1986 to 1999), the ACP countries' share rose by 64,3 %, and that of third countries by 64,5 %; over the same period, the OD share dropped by 22,4 %. In 1999, the market shares of rum sold on the Community market were the following: 64,7 % (or 346084 hl of pure alcohol) for rum from the ACP countries, 15,5 % (or 82706 hl of pure alcohol) for rum from other third countries and 19,8 % (or 105950 hl of pure alcohol, including 85000 hl of pure alcohol for mainland France) for OD rum.

This document reviews two proposals for a Council decision, submitted by the Commission: the first authorises France to extend the application of a reduced rate of excise duty on 'traditional' rum produced in its overseas departments (OD), while the second authorises Portugal to reduce the rate of excise duty on rum and liqueurs produced and consumed in Madeira and on liqueurs and eaux-de-vie produced and consumed in the Azores.

It is vital for the entire economy of the territories concerned to support the rum sector in the French overseas departments, since under French legislation only locally produced sugar cane may be used for the production of rum; hence, the survival of agriculture also depends on this decision.

By letters of 30 August and 13 September 2001 the Council consulted Parliament, pursuant to Article 299 (2) of the EC Treaty, on 1. the proposal for a Council decision authorising France to extend the application of a reduced rate of excise duty on 'traditional' rum produced in its overseas departments (COM(2001) 347 - 2001/0142 (CNS)), and 2. the proposal for a Council decision authorising Portugal to apply a reduced rate of excise duty in the autonomous region of Madeira on locally produced and consumed rum and liqueurs and in the autonomous region of the Azores on locally produced and consumed liqueurs and eaux-de-vie (COM(2001) 442 – 2001/0169(CNS)).

For Madeira, Portugal is also requesting authorisation to apply rate reductions of upwards of 50% for rum produced in the region (claiming that the current reduction is not enough to guarantee the continued viability of rum production), for liqueurs based on subtropical fruits, and for rum-based Poncha and Macia.

As for the system applicable to the traditional rum of her overseas departments, France argues that the production of rum has, thanks to this measure in particular, safeguarded the situation and also contributed to maintaining the cane-sugar-rum trade, the importance of which in economic and social terms in the overseas departments makes the measure indispensable.
