With a view to the first instance proceedings before the Community Patent Court, Article 4 of the Decision creates Annex II to the Protocol on the Statute of the Court of Justice including a number of provisions adapting the provisions of the Statute of the Court Justice which are applied to judicial panels according to Article 225a(6) of the EC Treaty.

This Article contains a provision inserting a new Title VI "Judicial Panels" into the Statute of the Court of Justice with a new Article 65 creating a legal basis to annex provisions to the Statute of the Court Justice relating to judicial panels created under Article 225a of the EC Treaty.

Therefore, for each judicial panel established in the future, a corresponding annex will be created to deal with the Statute provisions to be applied by the judicial panel concerned. Consequently the new Article 65 of the Statute of the Court of Justice consequently lays down that the provisions relating to the jurisdiction, the composition, and the organisation of judicial panels, and the procedure before them are to be set out in an annex to the Statute of the Court of Justice.

Neither Article 64 of the Rules of Procedure of the Court of First Instance nor Article 24 of the Statute of the Court of Justice, also applicable to the Court of First Instance pursuant to the first paragraph of Article 53 of that Statute, nor any other provision of the Rules of Procedure of the Court of First Instance and of the Statute of the Court of Justice, place any obligation on the Court of First Instance to advise the party lodging an action that his application is inadmissible when it has not been signed by a lawyer authorised to appear before the Community courts.

By applications lodged at the Court Registry on 6 December 2001, Procter Gamble Company (‘Procter Gamble’) appealed pursuant to Article 49 of the EC Statute of the Court of Justice against the judgments of the Court of First Instance of 19 September 2001 in Case T-128/00 Procter Gamble v OHIM (Square tablet with inlay) [2001] ECR II-2785 (‘Case T-128/00’) and Case T‑129/00 Procter Gamble v OHIM (Rectangular tablet with inlay) [2001] ECR II-2793 (‘Case T‑129/00’), (together hereinafter referred to as ‘the judgments under appeal’), by which the Court of First Instance partially dismissed its actions for annulment of the decisions of the Third Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) (‘OHIM’) of 8 March 2000 (Cases R‑506/1999‑1 and R‑508/1999‑1), which had rejected its appeals against the refusal to register as Community trade marks three-dimensional tablets for washing machines or dishwashers (‘the contested decisions’).

4. The Protocol on the new Statute of the Court of Justice of the European Communities annexed to the Treaty of Nice takes account only in part of these amendments. Pursuant to Article 62 of the Statute, in the cases provided for in Article 225(2) and (3) of the EC Treaty the First Advocate‑General may propose that the Court of Justice review the decision of the Court of First Instance where he considers that there is a serious risk of the unity or consistency of Community law being affected.
4. By letter of 2 October 2003 the Council consulted Parliament, pursuant to Article 245(2) of the EC Treaty and Article 160(2) of the Treaty establishing the European Atomic Energy Community, on the draft Council decision amending the Protocol on the Statute of the Court of Justice to lay down the conditions and limits for review by the Court of Justice of decisions delivered by the Court of First Instance (12464/2003 – 2003/0820(CNS)).

It is intended to take account of Declaration No 13 adopted on 26 February 2001 at the Nice Summit by the Conference of the Representatives of the Governments of the Member States, and to incorporate into the Statute of the Court of Justice the essential provisions of the procedure in Article 225(2) and (3) of the EC Treaty for review by the Court of Justice of decisions given by the Court of First Instance.
