This Directive does not criminalise behaviour which is not also subject to disciplinary penalties or other measures concerning a breach of official duties, in cases where such disciplinary penalties or other measures can be applied to the persons concerned.

(a) For the purposes of this Directive, passive corruption shall consist of the action of a public official, who, directly or through an intermediary, requests or accepts in advance advantages of any kind whatsoever or a promise of such an advantage, for himself or for a third party, for acting, delaying action or refraining from acting in accordance with his duty or in the exercise of his functions, whether or not in breach of his official obligations, in a way which damages or is likely to damage the Union's financial interests.

Any official who, in the course of or in connection with the performance of his duties, becomes aware of or honestly believes in the existence of breaches of law, non-compliance by other officials with obligations deriving from fundamental ethical principles, waste and/or risks detrimental to the interests of the European Union shall have the right to report the matter and to provide supporting information to either his immediate superior or his Director-General, or the persons in equivalent positions, or, if the matter concerns the competences of the European Anti-Fraud Office (OLAF), directly to OLAF.

Whereas the Disciplinary Committee rules on any breach of duty by the official concerned, particularly in the light of his obligations under the Staff Regulations and, more generally, compliance with EU law, and its opinion may lead the official’s institution to adopt a decision which may be favourable or unfavourable to him, the situation is entirely different with the decision to communicate information, since OLAF merely communicates to the national judicial authorities information which those authorities alone are responsible for assessing from the point of view of criminal law.

In that regard, there cannot be a close link between, on the one hand, a request for assistance under Article 24 of the Staff Regulations complaining of psychological harassment on the part of the superiors of the person concerned and, on the other, an implied decision rejecting that request and the claim for compensation for the breach by the institution concerned of its duty to have regard to the welfare of its officials. Whereas the acts complained of in the request for assistance must be regarded as acts imputable to their authors, that is not the case of the implied decision of rejection, which is an act imputable to the institution concerned.
