TRADUCTIONS EN CONTEXTE

In addition to the "television without frontiers" Directive, which constitutes the legal framework for the pursuit of television broadcasting activities in the European Union, reference should be made to Directive 93/83/EEC "cable and satellite" [49], which aims to coordinate certain rules concerning copyright and rights related to copyright applicable to satellite broadcasting and cable retransmission with a view to facilitating cross-border broadcasting of audiovisual programmes.
Naast de richtlijn "Televisie zonder grenzen", die het juridisch referentiekader vormt voor omroepactiviteiten in de Europese Unie, dient te worden verwezen naar Richtlijn 93/83/EEG "Kabel en satelliet" [49], waarmee wordt gestreefd naar coördinatie van een aantal voorschriften op het gebied van auteursrechten en naburige rechten die van toepassing zijn op satellietomroep en de doorgifte via de kabel, om grensoverschrijdende uitzending van audiovisuele programma's te vereenvoudigen.

The requirements under this Title shall not apply to collective management organisations when they grant, on the basis of the voluntary aggregation of the required rights, in compliance with the competition rules under Articles 101 and 102 TFEU, a multi-territorial licence for the online rights in musical works required by a broadcaster to communicate or make available to the public its radio or television programmes simultaneously with or after their initial broadcast as well as any online material, including previews, produced by or for the broadcaster which is ancillary to the initial broadcast of its radio or television programme.

The complaints in Germany and The Netherlands have also raised new issues, such as the financing of public broadcasters’ online activities. The Commission does not question that public broadcasters offer online services as part of their public service mission. However, the scope of such online activities and whether they are financed by public funds should be determined not by the public broadcasters themselves but by the Member States concerned, to ensure that only those services are included which serve the same democratic, social and cultural needs of society as traditional broadcasting.
