When Heads of Union Delegations act as subdelegated authorising officers of the Commission, they shall apply the Commission rules for the implementation of the budget and shall be subject to the same duties, obligations and accountability as any other subdelegated authorising officer of the Commission.

Underlines that according to Article 6 of the SESAR Financial Rules, no expenditure may be committed or authorised in excess of the appropriations authorised by the budget; is seriously concerned that for two budget headings – administrative expenditure, studies and development – authorised expenditure exceeded budgetary appropriations by 11 % and 9 % respectively; takes note that the Joint Undertaking considers that it can only enter the total payment appropriations once into the overall budget for 2007-2016, in order to avoid exceeding the total budget ceiling by the end of the SESAR development phase in 2016; reminds the Joint Undertaking that it must comply with its own Financial Rules and expects that authorised expenditure exceeding budgetary appropriations shall not occur in future financial years;

Emphasises that an ex ante assessment of all contracts and budget authorisations is essential if a high level of fraud-proofing is to be achieved; considers that such an ex ante assessment must be made by officials who are different from those responsible for initiating the operation and who are not subordinated to them;

22. Regrets that the Commission has not drawn up proposals on how to close the gap left by the scrapping of independent financial control; recalls that independent preliminary assessment of contracts and budget authorisations is essential if a high level of fraud-proofing is to be achieved;

If, for a given chapter, the authorisation of two or more provisional twelfths granted in the circumstances and under the procedures provided for in paragraph 3 is not sufficient to cover the expenditure necessary to avoid a break in continuity of the Communities' activity in the area covered by the chapter in question, authorisation may exceptionally be given to exceed the amount of the appropriations entered in the corresponding chapter of the budget of the preceding financial year.
4. Indien voor een bepaald hoofdstuk twee of meer voorlopige twaalfden die op de voorwaarden en volgens de procedures van lid 3 zijn toegestaan, niet toereikend zijn voor de uitgaven die nodig zijn om een breuk in de continuïteit van het optreden van de Gemeenschappen op het door het betrokken hoofdstuk bestreken gebied te voorkomen, kan bij wijze van uitzondering een overschrijding van het aan kredieten geboekte bedrag in het overeenkomstige hoofdstuk van de begroting van het voorgaande begrotingsjaar worden toegestaan.
