The quality of legislation drafting, which was the subject of the Commission communication Better lawmaking, [2] is of vital importance, influencing both the capacity of Member States to implement Community law and the effectiveness of Community legislation and its monitoring by Community institutions.

There is no business in any sector that can survive this type of economic context, but nevertheless it is a proven fact that, when there has been the political will to monitor imports closely, as has occurred in the past – and I can bear witness to this – the prices paid to Community producers have immediately recovered.

The European Commission introduced a twofold surveillance system aiming to monitor import trends from China as well as from other exporting countries into the EU. Chinese goods entering the Community were in particular subject to a system of prior import licences (the so-called ex-ante surveillance).
De Europese Commissie voerde een tweevoudig toezichtsysteem in om het oog te houden op de ontwikkelingen van de invoer uit China en uit andere exportlanden in de EU. (7) In its Resolution of 29 June 2000 on the follow-up to the Evora conference on health determinants, the Council considered that the increasing differences in health status and health outcomes between and within Member States called for renewed and coordinated efforts at national and Community level; welcomed the Commission's commitment to submit a proposal for a new public health programme containing a specific strand of action aimed at addressing health determinants by means of health promotion and disease prevention underpinned by intersectoral policy and agreed that there was a need to develop the appropriate knowledge base for this and, therefore, that an efficacious health monitoring system should be established for this purpose; stressed the importance of the new Community public health strategy building upon the activities on specific determinants taken in the existing programmes, especially with respect to tobacco, nutrition and alcohol and that it was important not only to ensure continuity with existing actions, but also to take forward work on these issues in a fully coherent and systematic way.
(7) In zijn resolutie van 29 juni 2000 over de follow-up van de conferentie van Evora inzake gezondheidsdeterminanten heeft de Raad verklaard dat de steeds groter wordende verschillen qua gezondheidssituatie en -resultaten tussen en binnen de lidstaten nieuwe en gecoördineerde inspanningen vergen op nationaal en communautair niveau, heeft hij de toezegging van de Commissie verwelkomd dat zij een voorstel zal indienen voor een nieuw programma voor de volksgezondheid, met een speciaal actieonderdeel voor het aanpakken van gezondheidsdeterminanten door middel van gezondheidsbevordering en ziektepreventie, ondersteund door een intersectoraal beleid, heeft hij ermee ingestemd dat als basis daarvoor de relevante kennis moet worden ontwikkeld en met het oog hierop een efficiënt systeem voor gezondheidsmonitoring moet worden opgezet, heeft hij het belang benadrukt van een nieuwe communautaire volksgezondheidsstrategie die voortbouwt op de activiteiten met betrekking tot specifieke factoren uit de bestaande programma's, vooral in verband met tabak, voeding en alcohol en heeft hij onderstreept dat er niet alleen gezorgd moet worden voor samenhang met de huidige acties, maar dat het werk met betrekking tot die thema's tevens volledig coherent en systematisch voortgezet moet worden.

This monitoring has proved even more necessary after Spain, which had brought its previous practice into line with Community rules, informed the Advisory Committee on Own Resources in July 2002 of the possible diversion of traffic to other Member States which offered unfair advantages or facilities to their importers as its own banana imports seemed to have fallen by more than 80%.

The Communication on Human Rights underlines the crucial importance of monitoring, evaluating and assessing the impact of projects, setting out that the Commission will develop a methodology of human rights impact assessment for cooperation projects and programmes and will monitor the impact of individual programmes and projects on human rights, encompassing, of course, the rights of indigenous peoples.
