In 2010, the Commission launched a broad consultation of all stakeholders including the European Parliament, Member States, the Court of Justice of the European Union (CJEU), the European Judicial Training Network (EJTN) and its members, Justice Forum[11] members in particular the Academy of European Law (ERA), the Council of Bars and Law Societies of Europe (CCBE), the Council of the Notariats of the European Union (CNUE), the European Network of Councils for the Judiciary (ENCJ), the Network of the Presidents of the Supreme Judicial Courts of the European Union, the Association of the Councils of State and Supreme Administrative Jurisdictions of the European Union.

A wide range of other actors at the European and international levels have expressed their deep concern about the reform of the Polish justice system: representatives of the judiciary across Europe, including the Network of Presidents of the Supreme Judicial Courts of the European Union and the European Network of Councils for the Judiciary, the Venice Commission, the Commissioner for Human Rights of the Council of Europe, the United Nations Human Rights Committee as well as numerous civil society organisations such as Amnesty International and the Human Rights and Democracy Network.

The Commission's Rule of Law Recommendation sent today to Poland covers four new legislative acts now adopted by thePolish Parliament which in the Commission's assessment will increase the systemic threat to the rule of law: the Law on the Supreme Court, the Law on the National Council for the Judiciary (both 'vetoed' on 24 July by the President of the Republic), the Law on the Ordinary Courts Organisation (signed by the President of the Republic on 25 July and awaiting publication and entry into force); and the Law on the National School of Judiciary (published and in force since 13 July).

R. whereas the time is ripe to take matters further, beginning with a no-holds-barred discussion of legal training for judges and practitioners and legal education at a forum involving the participation of members of the judiciary, the relevant national authorities – including councils for the judiciary and judicial training schools – and the Academy of European Law (ERA), the European Judicial Training Network (EJTN), the European Network of Councils for the Judiciary (ENCJ) and the European Law Institute (ELI);

– the Network of the Presidents of the Supreme Judicial Courts, the European Network of the Councils for the Judiciary, the Association of the Councils of State and Supreme Administrative Jurisdictions and the Eurojustice network of European Prosecutors-General, court officers and legal practitioners have a huge amount to offer by coordinating and promoting professional training for the judiciary and mutual understanding of other Member States’ legal systems and making it easier to resolve cross-border disputes and problems, and their activities must be facilitated and receive sufficient funding; this must lead to a fully-funded plan for European judicial training drawn up in liaison with the above-mentioned judicial networks, avoiding unnecessary duplication of programmes and structures and leading to the creation of a European Judicial Academy composed of the European Judicial Training Network and the Academy of European Law;

As acceptance by the courts and governments of the Member States is of utmost importance for the implementation and use of an identification and metadata system for case law, consultations on this recommendation have taken place with the Network of Presidents of the Supreme Judicial Courts of the European Union, the Association of the Councils of State and Supreme Administrative Jurisdictions of the European Union, the European Network of Councils for the Judiciary, the LEX-initiative, the CEN/Metalex workshop, Semic.EU, the European Commission, the Court of Justice of the European Union and the Publications Office of the European Union.
