Therefore, in order to ensure effective compliance by CSDs, credit institutions designated as settlement agents, the members of their management bodies and any other persons who effectively control their business or any other persons with the requirements of this Regulation, competent authorities should be able to apply administrative sanctions and other measures which are effective, proportionate and dissuasive.

The competent authorities shall be able to apply administrative sanctions and other measures, to CSDs, designated credit institutions, and, subject to the conditions laid down in national law in areas not harmonised by this Regulation, the members of their management bodies and any other persons who effectively control their business as well as to any other legal or natural person who under national law is held responsible for an infringement.

Regulation (EU) No 1024/2013 vested the ECB with some supervisory tasks and entitled the latter to impose on the credit institutions it supervises: (a) administrative pecuniary penalties when these institutions breach a requirement under directly applicable Union law in relation to which administrative pecuniary sanctions shall be made available to competent authorities under the relevant Union law; and (b) sanctions in accordance with Regulation (EC) No 2532/98 in case of a breach of ECB regulations or decisions (hereinafter jointly referred to as ‘administrative penalties’).

The ESAs shall maintain a website with links to each competent authority's publication of administrative sanctions and measures imposed in accordance with Article 60 on credit institutions and financial institutions, and shall show the time period for which each Member State publishes administrative sanctions and measures.

For the purpose of carrying out the tasks conferred upon it by this Regulation, where credit institutions, financial holding companies, or mixed financial holding companies, intentionally or negligently , breach a requirement under relevant directly applicable acts of Union law in relation to which administrative pecuniary sanctions shall be made available to competent authorities under the relevant Union law, the ECB may impose administrative pecuniary sanctions of up to twice the amount of the profits gained or losses avoided because of the breach where those can be determined, or up to 10% of the total annual turnover, as defined in relevant Union law, of a legal person in the preceding business year or such other pecuniary sanctions as may be provided for in relevant Union law .

(32b) Nothing in this regulation should be understood as conferring on the ECB the power to impose sanctions on natural or legal persons other than credit institutions, financial holding companies or mixed financial holding companies, without prejudice to the ECB's power to require national authorities to act in order to ensure that appropriate sanctions are imposed.
(32 ter) Geen enkele bepaling in deze verordening verleent de ECB de bevoegdheid om sancties op te leggen aan andere natuurlijke personen of rechtspersonen dan kredietinstellingen, financiële holdings of gemengde financiële holdings, onverminderd de bevoegdheid van de ECB om van de nationale autoriteiten te verlangen dat zij ervoor zorgen dat er passende sancties worden opgelegd.

The Directive lays down the procedure to be followed where a credit institution does not comply with the obligations incumbent on it as a member of a deposit-guarantee scheme, namely that the competent authorities take all appropriate measures, including sanctions going as far as withdrawal of the credit institution's authorisation, to ensure it complies with its obligations.
De richtlijn bepaalt de procedure ingeval een kredietinstelling niet voldoet aan de verplichtingen die uit hoofde van haar deelneming aan een depositogarantiestelsel op haar rusten. 2. If a credit institution does not comply with the obligations incumbent on it as a member of a deposit-guarantee scheme, the competent authorities which issued its authorization shall be notified and, in collaboration with the guarantee scheme, shall take all appropriate measures including the imposition of sanctions to ensure that the credit institution complies with its obligations.
2. Indien een kredietinstelling niet voldoet aan de verplichtingen die uit hoofde van haar deelneming aan een depositogarantiestelsel op haar rusten, worden de bevoegde autoriteiten die de vergunning hebben verleend, daarvan in kennis gesteld en nemen deze, in samenwerking met het garantiestelsel, alle passende maatregelen, met inbegrip van sancties, om ervoor te zorgen dat de kredietinstelling haar verplichtingen nakomt.
