IN-CONTEXT TRANSLATIONS

Whereas offences should be punishable in accordance with this Directive when committed intentionally and at least in serious cases, sanctions for breaches of Regulation (EU) No ./2014 [MAR] do not require that intent is proven or that they are qualified as serious. In the application of the law transposing this Directive, Member States should ensure that imposition of criminal sanctions on the basis of offences foreseen by this Directive and of administrative sanctions in accordance with the Regulation (EU) No ./2014 [MAR] does not lead to the breach of the principle of ne bis in idem.
Bij de toepassing van het recht waarin deze richtlijn is omgezet, moeten de lidstaten ervoor zorgen dat het opleggen van strafrechtelijke sancties op grond van onder deze richtlijn vallende strafbare feiten en van administratieve sancties overeenkomstig Verordening (EU) nr./2014 [MAR ] niet leidt tot schending van het „ne bis in idem”-beginsel.

Members States shall ensure that if an administrative sanction has already been applied, no criminal sanction shall be applied in relation to the same facts in case the administrative and the criminal sanctions are of the same nature.

Although intentionally passing on counterfeit currency which has been received in good faith could be sanctioned with a different type of criminal sanction, including fines, in the national law of the Member States, those national laws should provide for imprisonment as a maximum sanction.

2a. Competent authorities shall also cooperate closely with the authorities of any Member State responsible for the investigation or prosecution of any criminal offences arising from conduct referred to in Article 25, to ensure that that the administrative and criminal measures and sanctions produce the desired result and to coordinate their action to avoid possible duplication or overlap where the breach may result in both criminal sanctions and administrative measures or sanctions.
2 bis. Minimum rules on criminal offences and on criminal sanctions for market abuse, which would be transposed into national criminal law and applied by the criminal justice systems of the Member States, can contribute to ensuring the effectiveness of this Union policy by demonstrating social disapproval of a qualitatively different nature compared to administrative sanctions or compensation mechanisms under civil law.
Minimumregels voor strafbare feiten en strafrechtelijke sancties voor marktmisbruik, die zouden worden omgezet in het nationale strafrecht en toegepast binnen de strafrechtsstelsels van de lidstaten, kunnen ertoe bijdragen om de doeltreffendheid van dit EU-beleid te verzekeren doordat zij de maatschappelijke afkeuring kwalitatief anders uitdrukken dan administratieve sancties of compensatiemechanismen krachtens het burgerlijke recht.

This wording makes it clearer that the offences referred to in Articles 3 and 4 must in all cases be punishable by criminal sanctions, although the possibility whereby the Member States may impose additional sanctions of a different kind on top of criminal sanctions must not be excluded (see my amendment to Article 5(5)).
