6. Where the customs legislation provides for a favourable tariff treatment of goods, or for relief or total or partial exemption from import or export duty pursuant to points (d) to (g) of Article 56(2), Articles 203, 204, 205 and 208 or Articles 259 to 262 of this Regulation or pursuant to Council Regulation (EC) No 1186/2009 of 16 November 2009 setting up a Community system of reliefs from customs duty (15) such favourable tariff treatment, relief or exemption shall also apply in cases where a customs debt is incurred pursuant to Articles 79 or 82 of this Regulation, on condition that the failure which led to the incurrence of a customs debt did not constitute an attempt at deception.
6. Where customs legislation provides for a favourable tariff treatment of goods, or for relief or total or partial exemption from import or export duties, pursuant to Article 33(2)(d) to (g), Articles 130 to 133 or Articles 171 to 174, or pursuant to Council Regulation (EEC) No 918/83 of 28 March 1983 setting up a Community system of reliefs from customs duty (12), such favourable tariff treatment, relief or exemption shall also apply in cases where a customs debt is incurred pursuant to Articles 46 or 49 of this Regulation, on condition that the failure which led to the incurrence of a customs debt did not constitute an attempt at deception.
4. Indien de douanewetgeving in een gunstige tariefbehandeling, een ontheffing of een gehele of gedeeltelijke vrijstelling van invoer- of uitvoerrechten voorziet overeenkomstig artikel 33, lid 2, onder d) tot en met g), de artikelen 130 tot en met 133 of de artikelen 171 tot en met 174, dan wel overeenkomstig Verordening (EEG) nr. 918/83 van de Raad van 28 maart 1983 betreffende de instelling van een communautaire regeling inzake douanevrijstellingen (12), is die gunstige tariefbehandeling, ontheffing of vrijstelling ook van toepassing indien een douaneschuld ontstaat overeenkomstig de artikelen 46 of 49 van deze verordening, mits het verzuim dat tot het ontstaan van de douaneschuld heeft geleid, geen poging tot bedrog inhield.

The rights conferred by this Directive shall not extend to the provision of services as counterparty in transactions carried out by public bodies dealing with public debt or by members of the European System of Central Banks performing their tasks as provided for by the Treaty and the Statute of the European System of Central Banks and of the European Central Bank or performing equivalent functions under national provisions.
