Following the incorporation into the EEA Agreement of Directive 2009/29/EC by Decision of the EEA Joint Committee No 152/2012, the limit set by Article 10a(5) of Directive 2003/87/EC, the harmonised allocation rules and the cross-sectoral correction factor are to be applied within the EEA-EFTA countries.
Na de opneming van Richtlijn 2009/29/EG in de EER-overeenkomst bij Besluit nr. 152/2012 van het Gemengd Comité van de EER moeten de bij artikel 10 bis, lid 5, van Richtlijn 2003/87/EG vastgestelde beperking, de geharmoniseerde toewijzingsregels en de transsectorale correctiefactor in de EER-EVA-landen worden toegepast.

Whenever a new measure with EEA relevance is adopted, the EFTA Secretariat drafts a Joint Committee decision to amend the annex of the respective agreement, which is normally adopted later by the Joint Committee.

If all 3 countries conclude that it is, a draft Joint Committee Decision (JCD) is prepared by the EFTA Secretariat with a view to amending the EEA agreement.
