Despite the Court of Auditors’ opinion that the accounts of the European Judicial Cooperation Unit (Eurojust) are reliable and that the underlying transactions are legal and regular, I am concerned at the rapporteur’s evaluation that ‘the lack of indicators, the deficits in measurement of user satisfaction and the lack of coordination between the budget and the work programme make it difficult to evaluate Eurojust’s performance’.

The national members of the Provisional Judicial Cooperation Unit appointed by the Member States under the Council Decision 2000/799/JHA of 14 December 2000 setting up a Provisional Judicial Cooperation Unit(14) shall take on the role of national member of Eurojust under Article 2 of this Decision until the national member of the Member State concerned is definitively appointed but not after the end of the second month after the entry into force of this Decision, on which date their functions shall cease.

The competent authorities of the Member States shall, where appropriate, in investigations into counterfeiting and offences related to the counterfeiting of the euro make use of the facilities offered by the Provisional Judicial Cooperation Unit and, subsequently, the facilities for cooperation offered by Eurojust once it has been established, in accordance with the provisions laid down in the instruments establishing the Provisional Judicial Cooperation Unit and Eurojust.

The Treaty of Nice supplements Article 31 of the EU Treaty with a reference to and description of the tasks of "Eurojust" (European Judicial Cooperation Unit), whose task will be to facilitate proper coordination between national prosecuting authorities within the framework of judicial cooperation in criminal matters.
