whereas the OSCE expressed serious reservations regarding the scope of the Hungarian laws (material and territorial scope), freedom of expression and the regulation of content, the appointment of one person to act as the national media and telecommunications authority, and compliance with the principles governing public-service broadcasting (4), indicating that the new legislation undermined media pluralism, abolished the political and financial independence of the public-service media and cemented the negative features for the free media in the long term, and that the Media Authority and Media Council were politically homogeneous (5) and exerted pervasive and centralised governmental and political control over all media; whereas further concerns included the disproportionate and extreme penalties imposed for debatable and undefined reasons, the lack of an automatic procedure for suspending penalties in the event of an appeal to the courts against a Media Authority ruling, the violation of the principle of the confidentiality of journalistic sources and the protection of family values,

Calls on Member States, while implementing the right to free movement and residence, not to place unjustified administrative burdens on Union citizens and their family members, including third-country family members, that are not expressly provided for in Directive 2004/38/EC, as these are contrary to EC law and an unjustified obstacle to the exercise of a freedom conferred directly by the EC Treaty, which is not dependent on their having completed administrative procedures; draws to the attention of Member States that it is their duty to facilitate administrative practices linked to the exercise of the right to free movement and calls on Members States to keep track of and report all administrative and court decisions based on Article 3(2) of the Directive; reminds Member States of their obligation to facilitate the entry of third-country family members of Union citizens, in order to allow them to lead a normal family life in the host Member State;

Calls on the state authorities to ensure that all detention procedures meet the minimum requirements of international legal standards, proper treatment, registration and prosecution, prompt access to family members, lawyers and independent courts, as well as accountability for any violation of such procedures;
