Considers it regrettable that, so far, the EU has kept its government procurement markets largely open to international competition, while EU companies still face substantial barriers abroad; calls on the Commission to guarantee that EU trade agreements contain instruments for our companies, especially SMEs, to compete abroad on equal terms with foreign national companies; demands as well clear regulation of, and easy access to information concerning, tenders and awarding criteria, and the lifting of discriminatory and unjustified trade barriers in the field of government procurement, services or investment (such as fiscal discrimination, regulatory barriers to the establishment of branches or subsidiaries, and restrictions on access to financing); calls on our partner countries to apply principles of open government in order to guarantee transparency and avoid conflicts of interest, and to use PPPs practice with caution, taking into account not only cost-benefit analyses and the viability of the projects, but also the financial and technical capacity of public authorities to supervise services or infrastructure delivery in line with general public interest;

Differences in national corporate governance arrangements may create uncertainty and costs for both issuers and investors, which need to be addressed to promote an efficient integration of EU capital markets. As announced in its 1999 Financial Services Action Plan, the Commission launched in 2001 a review of the main corporate governance codes relevant to the EU. The full comparative study, prepared for the Commission by Weil, Gotshal Manges LLP, was finalised in March 2002 [11]and concluded that the EU should not devote time and effort to the development of a European corporate governance code: the study identified as a more valuable area for the European Commission to focus its efforts on the reduction of legal and regulatory barriers to shareholder engagement in cross-border voting ("participation barriers") as well as the reduction of barriers to shareholders ability to evaluate the governance of companies ("information barriers").

The Commission should be empowered to adopt regulatory technical standards in accordance with Article 290 TFEU and with Articles 10 to 14 of Regulation (EU) No 1093/2010 and of Regulation (EU) No 1095/2010 with regard to the detailed elements of the settlement discipline measures; the reporting of internalised settlement; information and other elements to be included by a CSD in its application for authorisation; conditions under which the competent authorities of CSDs may approve their participations in the capital of certain legal entities, the information that different authorities shall supply each other when supervising CSDs; the information that the applicant CSD shall provide ESMA in its application for recognition; the elements of the governance arrangements for CSDs; the details of the records to be kept by CSDs; the risks to be taken into account by CSDs when carrying out a comprehensive risk assessment, and competent authorities assessing the reasons for refusal of requests for access; the elements of the procedure for access of participants and issuers to CSDs, access between CSDs and between CSDs and other market infrastructures; the details of the measures to be taken by CSDs so that the integrity of the issue is maintained; the mitigation of the operational and investment risks and of the risks derived from the CSD links; the details of the capital requirements for CSDs; the details of the application for authorisation to provide banking-type ancillary services; the capital surcharge and the prudential requirements on credit and liquidity risks for CSDs and designated credit institutions that are authorised to provide banking-type ancillary services.

Urges that, in the era of convergence, mobility and interactivity of all political decisions including those within the EU – whether concerning the setting of the regulatory framework to govern the services and content transmitted by the new media, or in the fields of infrastructure measures or of competition law and subsidies – the Charter of Fundamental Rights of the European Union and the UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions of 20 October 2005, which not only lays down an obligation on the Member States to protect cultural diversity and promote multiculturalism but also enshrines the dual nature of the audiovisual media as both economic and a cultural goods, should be fully complied with; recalls that the information society and properly managed ICT may prove extremely positive in strengthening and protecting cultural diversity and multilingualism;
