4. Where such errors, irregularities or fraud are attributable to the beneficiary, or should the beneficiary breach his or her obligations under a grant agreement or decision, the authorising officer responsible may, in addition, reduce the grant or recover amounts unduly paid under the grant agreement or decision, in proportion to the seriousness of the errors, irregularities or fraud or of the breach of obligations, provided that the beneficiary has been given the opportunity to make observations.
4. Wanneer dergelijke fouten, onregelmatigheden of fraude zijn toe te schrijven aan de begunstigde of wanneer de begunstigde zijn verplichtingen uit hoofde van een subsidieovereenkomst of subsidiebesluit niet nakomt, kan de bevoegde ordonnateur, mits de begunstigde in de gelegenheid is gesteld opmerkingen te formuleren, bovendien de subsidie verlagen of bedragen terugvorderen die ten onrechte zijn betaald uit hoofde van de subsidieovereenkomst of het subsidiebesluit, in verhouding tot de ernst van de fouten, onregelmatigheden of fraude of van de niet nagekomen verplichtingen.

5. Where controls or audits demonstrate systemic or recurrent errors, irregularities, fraud or breach of obligations attributable to the beneficiary and having a material impact on a number of grants awarded to that beneficiary under similar conditions, the authorising officer responsible may suspend implementation of all the grants concerned or, where appropriate, terminate the concerned grant agreements or decisions with that beneficiary, in proportion to the seriousness of the errors, irregularities, fraud or of the breach of obligations, provided that the beneficiary has been given the opportunity to make observations.
5. Wanneer controles of audits stelselmatige of terugkerende fouten, onregelmatigheden of fraude dan wel niet-nagekomen verplichtingen aan het licht brengen die zijn toe te schrijven aan de begunstigde en van grote invloed zijn op een aantal subsidies die deze begunstigde onder soortgelijke voorwaarden zijn toegekend, kan de bevoegde ordonnateur, mits de begunstigde in de gelegenheid is gesteld opmerkingen te formuleren, de uitvoering van alle desbetreffende subsidies opschorten of, indien van toepassing, de desbetreffende subsidieovereenkomsten of subsidiebesluiten met die begunstigde beëindigen, in verhouding tot de ernst van de fouten, onregelmatigheden of fraude, dan wel niet-nagekomen verplichtingen.

(2) The Munich Convention on the Grant of European Patents of 5 October 1973 (hereinafter referred to as the "Munich Convention") established the European Patent Office (hereinafter referred to as "the Office") and entrusted it with the task of granting European patents.

It was Parliament’s intention initially to grant the Committee of European Securities Regulators (CESR) the power to take care of registration, but, sadly, it did not work because of the tug-of-war that will inevitably ensue between the big countries and large financial centres to attract those head offices and be able to play first fiddle there, in an attempt to get the large rating offices under their wings.
