Article 19(4) of the ILO Constitution, on the adoption and ratification of Conventions, similarly applies to Protocols, which are binding international agreements, subject to ratification and linked to Conventions.

On 13 June 2012 the International Labour Conference (ILC) adopted a resolution ‘Concerning the measures on the subject of Myanmar adopted under article 33 of the ILO Constitution’ (ILC resolution).

5. Dialogue and multilateral affairs – The promotion of the rights of the child constitute an integral part of the EU’s human rights policy. The EU Guidelines for the Promotion and Protection of the Rights of the Child stress the need to mainstream these rights in EU policy and action. The Council emphasizes that the elimination of child labour is a legal obligation based in international treaties and conventions, in particular the Convention on the Rights of the Child and ILO Conventions 138 and 182.

Article 19, paragraph eight of the ILO Constitution states that ‘in no case, shall the adoption of any Convention or Recommendation by the Conference, or the ratification of any Convention by any Member, be deemed to affect any law, award, custom or agreement which ensures more favourable conditions to the workers concerned than those provided for in the Convention or Recommendation’.

This follow-up mechanism, which seeks to assist the efforts made by members, is additional to the supervisory mechanisms established by the ILO constitution for the application of ratified conventions as well as the special Freedom of Association procedure, which already applied to non-ratifying states.

In addition to the regular supervisory instruments, the ILO constitution provides for more specific courses of action.
