2. Member States shall ensure that the relevant authorities are able to require undertakings providing public communications networks and/or publicly available electronic communications services to block, on a case-by-case basis, access to numbers or services where this is justified by reasons of fraud or misuse and to require that in such cases providers of electronic communications services withhold relevant interconnection or other service revenues’.

The need to make the best use of the digital dividend taking into account all the potential social, cultural and economic benefits, while considering also the different national circumstances in Member States; The potential use of the digital dividend as an opportunity both to extend broadcasting services and to provide for example a better picture and audio quality as well as to introduce new communication services such as wireless broadband communications, additional terrestrial broadcasting services and mobile multimedia services; The genuine right of Member States to determine the amount of spectrum from the digital dividend to be used for the achievement of general interest objectives in conformity with Community law, including broadcasting services; The need for close cooperation between Member States in coordinating spectrum usage in the EU in order to enhance its more efficient use and to avoid harmful cross-border interference among Member States and between Member States and third countries; The potential benefits of identifying the parts of the UHF bands for non mandatory use by uni – and bidirectional networks in the interest of achieving more efficient spectrum use; in order to facilitate the emergence of innovative and successful national or cross-border services the radio interference potential arising from the co-existence of uni – and bidirectional networks in the same band as well as existing authorisations should be taken into account; The potential benefits of close cooperation between Member States in coordinating spectrum usage in the EU in terms of economies of scale; The benefits of ensuring flexibility of usage of the digital dividend with the exception of services of general interest, including those serving cultural and linguistic diversity and media pluralism, while taking into account constraints necessary to avoid harmful interference and to safeguard efficient spectrum use; The need to take into account different situations reg ...

(c) "electronic communications service" means a service normally provided for remuneration which consists wholly or mainly in the conveyance of signals on electronic communications networks, including telecommunications services and transmission services in networks used for broadcasting, but exclude services providing, or exercising editorial control over, content transmitted using electronic communications networks and services; it does not include information society services, as defined in Article 1 of Directive 98/34/EC, which do not consist wholly or mainly in the conveyance of signals on electronic communications networks;

This framework does not therefore cover the content of services delivered over electronic communications networks using electronic communications services, such as broadcasting content, financial services and certain information society services, and is therefore without prejudice to measures taken at Community or national level in respect of such services, in compliance with Community law, in order to promote cultural and linguistic diversity and to ensure the defence of media pluralism.

To this end, six topics have been identified: - "Interactive digital multimedia services" the aim of the research being to develop systems and services combining sound, images and digital data; - "Photonic technologies" in order to deploy fully optical networks by the year 2000; - "High-speed networking" in order to develop services such as videophones, teleworking and social care, thanks to efficient integrated networks; - "Mobility and personal communications networks" the aim of which is to offer the public a new generation of flexible and reliable cordless transmission systems; - "Intelligence in networks and service engineering" the aim being to provide intelligent communication systems and enable users themselves to determine the type of services offered; - "Quality, security and safety of communication services and systems" in order to ensure the reliability and security of information transmitted (electronic signatures).
