In cases where the duration of a protection measure is greater than 12 months, the limitation of the effects of recognition under this Regulation should be without prejudice to the right of the protected person to invoke that protection measure under any other available legal act of the Union providing for recognition or to apply for a national protection measure in the Member State addressed.

Irrespective of whether the place in question or the extent of the area covered by the protection measure is described in the protection measure by one or more specific addresses or by reference to a circumscribed area which the person causing the risk may not approach or enter, respectively (or a combination of the two), the recognition of the obligation imposed by the protection measure relates to the purpose which the place serves for the protected person rather than to the specific address.

In the light of the foregoing and provided that the nature and the essential elements of the protection measure are maintained, the competent authority of the Member State addressed should be allowed to adjust the factual elements of the protection measure where such adjustment is necessary in order for the recognition of the protection measure to be effective in practical terms in the Member State addressed.
In het licht van het bovenstaande en mits de aard en de essentiële elementen van de beschermingsmaatregel behouden blijven, moet het de bevoegde instantie van de aangezochte lidstaat worden toegestaan de feitelijke elementen van de beschermingsmaatregel aan te passen wanneer dit noodzakelijk is om de erkenning van de beschermingsmaatregel in de praktijk effect te doen sorteren in de aangezochte lidstaat.

Therefore, the competent authority in the executing State is not required in all cases to take the same protection measure as those which were adopted in the issuing State, and has a degree of discretion to adopt any measure which it deems adequate and appropriate under its national law in a similar case in order to provide continued protection to the protected person in the light of the protection measure adopted in the issuing State as described in the European protection order.

‘European protection order’ means a decision, taken by a judicial or equivalent authority of a Member State in relation to a protection measure, on the basis of which a judicial or equivalent authority of another Member State takes any appropriate measure or measures under its own national law with a view to continuing the protection of the protected person.
„Europees beschermingsbevel”, een door een rechterlijke of daarmee gelijkgestelde autoriteit van een lidstaat genomen beslissing betreffende een maatregel om een persoon te beschermen, op grond waarvan een rechterlijke of daarmee gelijkgestelde autoriteit van een andere lidstaat een volgens haar eigen nationale recht passende maatregel of maatregelen ter verdere bescherming van de betrokkene neemt.

Those measures included, in particular, Commission Decision 2005/692/EC of 6 October 2005 concerning certain protection measures in relation to avian influenza in several third countries (3), Commission Decision 2005/733/EC of 19 October 2005 concerning certain protection measures in relation to a suspicion of highly pathogenic avian influenza in Turkey and repealing Decision 2005/705/EC (4) and Commission Decision 2006/7/EC of 9 January 2006 concerning certain protection measures in relation to the import of feathers from certain third countries (5).
