Following a preliminary examination pursuant to Article 15 (6) of Regulation No 17, the Commission is of the opinion that, as regards the provisions of the agreements concluded between Société d'Hygiène Dermatologique de Vichy and wholesaler-distributors and retail pharmacists, in so far as the said agreements provide for the exclusive distribution of Vichy cosmetic products through pharmacies, i.e. by virtue of the fact that the approval of authorized distributors of Vichy products is subject to their having the status of dispensing chemist, Article 85 (1) of the EEC Treaty applies and that application of Article 85 (3) is not justified.
Na een voorlopig onderzoek uit hoofde van artikel 15, lid 6, van Verordening nr. 17 is de Commissie van oordeel dat met betrekking tot de bepalingen van de overeenkomsten die tussen de Société d'Hygiène Dermatologique de Vichy en de grossiers-verdelers alsmede de apothekers-kleinhandelaren zijn gesloten, voor zover deze overeenkomsten in de exclusieve distributie van de kosmetische produkten van Vichy in officina-apotheken voorzien, te weten het feit dat uitsluitend officina-apothekers als erkend distributeur van Vichy-produkten kunnen worden erkend, de voorwaarden voor de toepassing van artikel 85, lid 1, van het EEG-Verdrag zijn vervuld en toepassing van artikel 85, lid 3, niet gerechtvaardigd is.

(17) The distribution agreements concluded between Vichy's general agents and the wholesaler-distributors or pharmacist-retailers are agreements between undertakings within the meaning of Article 85 (1).

If the products were not distributed exclusively through retail pharmacies, the consumer would have a wider choice, without being deprived of the possibility of purchasing products through pharmacies should he wish to have the advice of a pharmacist.
Zonder een alleenverkooprecht van apotheken zou de consument meer keuze hebben en toch de mogelijkheid behouden de produkten in de apotheek te kopen als hij het advies van de apotheker wil inwinnen.
