1. The EPPO shall, taking into account the state of the art, the cost of implementation and the nature, scope, context and purposes of processing, as well as the risks of varying likelihood and severity for rights and freedoms of natural persons posed by the processing, both at the time of the determination of the means for processing and at the time of the processing itself, implement appropriate technical and organisational measures, such as pseudonymisation, which are designed to implement data protection principles, such as data minimisation, in an effective manner and to integrate the necessary safeguards into the processing, in order to meet the requirements of this Regulation and protect the rights of the data subjects.
1. Het EOM gaat, rekening houdend met de stand van de techniek, de uitvoeringskosten en de aard, de reikwijdte, de context en de doeleinden van de verwerking, alsmede met de qua waarschijnlijkheid en ernst uiteenlopende risico’s voor de rechten en vrijheden van natuurlijke personen, die aan de verwerking zijn verbonden, zowel bij de bepaling van de verwerkingsmiddelen als bij de verwerking zelf, over tot het nemen van passende technische en organisatorische maatregelen, zoals pseudonimisering, die zijn opgesteld met als doel de gegevensbeschermingsbeginselen, zoals gegevensminimalisatie, op een doeltreffende manier uit te voeren en de nodige waarborgen in de verwerking in te bouwen ter naleving van de voorschriften van deze verordening en ter bescherming van de rechten van de betrokkenen.

Member States shall provide for the controller, taking into account the state of the art, the cost of implementation and the nature, scope, context and purposes of processing, as well as the risks of varying likelihood and severity for rights and freedoms of natural persons posed by the processing, both at the time of the determination of the means for processing and at the time of the processing itself, to implement appropriate technical and organisational measures, such as pseudonymisation, which are designed to implement data protection principles, such as data minimisation, in an effective manner and to integrate the necessary safeguards into the processing, in order to meet the requirements of this Directive and protect the rights of data subjects.

De lidstaten schrijven voor dat de verwerkingsverantwoordelijke, rekening houdend met de stand van de techniek, de uitvoeringskosten en de aard, de reikwijdte, de context en de doeleinden van de verwerking, alsmede met de qua waarschijnlijkheid en ernst uiteenlopende risico's voor de rechten en vrijheden van natuurlijke personen, welke aan de verwerking zijn verbonden, zowel bij de bepaling van de verwerkingsmiddelen als bij de verwerking zelf overgaat tot het nemen van passende technische en organisatorische maatregelen, zoals pseudonimisering, die zijn opgesteld met als doel de gegevensbeschermingsbeginselen, zoals gegevensminimalisatie, op een doeltreffende manier uit te voeren en de nodige waarborgen in de verwerking in te bouwen ter naleving van de voorschriften van deze richtlijn en ter bescherming van de rechten van de betrokkenen.

Taking into account the state of the art, the cost of implementation and the nature, scope, context and purposes of processing as well as the risks of varying likelihood and severity for rights and freedoms of natural persons posed by the processing, the controller shall, both at the time of the determination of the means for processing and at the time of the processing itself, implement appropriate technical and organisational measures, such as pseudonymisation, which are designed to implement data-protection principles, such as data minimisation, in an effective manner and to integrate the necessary safeguards into the processing in order to meet the requirements of this Regulation and protect the rights of data subjects.

Rekening houdend met de stand van de techniek, de uitvoeringskosten, en de aard, de omvang, de context en het doel van de verwerking alsook met de qua waarschijnlijkheid en ernst uiteenlopende risico's voor de rechten en vrijheden van natuurlijke personen welke aan de verwerking zijn verbonden, treft de verwerkingsverantwoordelijke, zowel bij de bepaling van de verwerkingsmiddelen als bij de verwerking zelf, passende technische en organisatorische maatregelen, zoals pseudonimisering, die zijn opgesteld met als doel de gegevensbeschermingsbeginselen, zoals minimale gegevensverwerking, op een doeltreffende manier uit te voeren en de nodige waarborgen in de verwerking in te bouwen ter naleving van de voorschriften van deze verordening en ter bescherming van de rechten van de betrokkenen.

Highlights in this context the positive impact of secondary metals, which help to significantly reduce energy and raw material input; calls therefore on the Commission to facilitate the development and functioning of secondary metal markets; encourages the establishment of a circular economy at every base metals production plant in order to link the exploitation of by-products and recycled metals with the aim of increasing their competitiveness; calls for it to be made mandatory to establish a circular economy at every base metals production plant in order to link the exploitation of by-products and recycled metals with the aim of increasing their competitiveness; adopts the aim of making rapid progress in the recycling of rare earths and critical metals consumed in the Union; calls for the development of strong links between the base metal recycling sector and other industries in order to strengthen the size and resilience of the industrial base, in particular in regions affected by deindustrialisation; emphasises in this context the large potential of product and material substitution and increasing the use of scrap metal inter alia in steel and aluminium production; stresses that most base metals can be recycled many times for a fraction of the energy used for primary production; is concerned by the large energy loss for Europe caused by the legal and illegal export of aluminium and copper to countries such as China and India, states which have established aluminium export bans themselves; believes that high environmental standards and circular economy principles should be fundamental to development and innovation investments in the base metals industry sector in Europe; calls on the Commission to develop economic incentives for recycling metals, including currently uneconomical critical raw materials such as rare earths, to investigate how markets for recycled materials can be supported by inter alia green certificates for recycled materials, eco-d ...

8. Reiterates its opinion that bulk data transfers mark a departure from the principles underpinning EU legislation and practice, and asks the Commission and Council to address this issue properly in the negotiations, bearing in mind that the TFTP is currently designed in such a way that it does not allow for targeted data exchange; solutions should include restricting the scope of the transferred data and listing the types of data that the designated providers are able to filter and extract, as well as the types of data which may be included in a transfer;
8. stelt nogmaals dat de doorgifte van gegevens in bulk een afwijking betekent van de beginselen die ten grondslag liggen aan de wetgeving en de praktijk in de EU, en verzoekt de Commissie en de Raad deze kwestie in de onderhandelingen naar behoren aan de orde te stellen, in het besef dat het TFTP momenteel zodanig is opgezet dat doelgerichte uitwisseling van gegevens niet mogelijk is; voor oplossingen moet onder meer worden gedacht aan beperking van de omvang van de doorgegeven gegevens en inventarisering van de soorten gegevens die de aangewezen aanbieders kunnen filteren en extraheren alsook de soorten gegevens die in een doorgifte kunnen worden opgenomen;

Since those measures are of general scope and are designed to amend non-essential elements of this Directive by the adaptation of the methodological principles and values, they must be adopted in accordance with the regulatory procedure with scrutiny provided for in Article 5a of Decision 1999/468/EC.
Daar het maatregelen van algemene strekking betreft tot wijziging van niet-essentiële onderdelen van deze richtlijn door de methodologische beginselen en waarden aan te passen, moeten ze worden vastgesteld volgens de in artikel 5 bis van Besluit 1999/468/EG bepaalde regelgevingsprocedure met toetsing.
