One of the main principles of this coordination is to determine the social security legislation which is applicable to a migrant worker. As a rule, such a worker is subject to the social security legislation of the Member State where he or she is employed.
Een van de hoofdbeginselen van deze coördinatie is vast te stellen welke socialezekerheidswetgeving op een migrantenwerker van toepassing is. In de regel valt zo’n werknemer onder de socialezekerheidswetgeving van de lidstaat waar hij of zij werkzaam is.

This Article shall apply to special non-contributory cash benefits which are provided under legislation which, because of its personal scope, objectives and/or conditions for entitlement has characteristics both of the social security legislation referred to in paragraph 1 and of social assistance.

The close link between social security legislation and those contractual provisions which complement or replace such legislation and which have been the subject of a decision by the public authorities rendering them compulsory or extending their scope may call for similar protection with regard to the application of those provisions to that afforded by this Regulation.
De nauwe band tussen de socialezekerheidswetgeving en de contractuele bepalingen die deze wetgeving aanvullen of vervangen, en die door een besluit van de overheid verplicht zijn gemaakt dan wel een ruimere werkingssfeer hebben gekregen, kan ten aanzien van de toepassing van die contractuele bepalingen een soortgelijke bescherming noodzakelijk maken als die welke door de verordening wordt geboden.

(5) In order to be able to identify more easily and beyond doubt the social security legislation of the Member State to which the assistants to MEPs are subject, and in order to provide them with appropriate social cover, it seemed appropriate to introduce, for their benefit, a right of option regarding the social security legislation to be applicable to them.
(5) Om gemakkelijker en zonder twijfel de socialezekerheidswetgeving van de lidstaat te kunnen vaststellen waaronder de medewerkers van de leden van het Europees Parlement vallen en om ervoor te zorgen dat deze een passende sociale verzekering krijgen, is het nodig gebleken te hunnen gunste te voorzien in een keuzerecht wat de socialezekerheidswetgeving betreft die op hen van toepassing is.

(4) In order to be able to identify more easily and beyond doubt the social security legislation of the Member State to which the European parliamentary assistants are subject, and in order to provide the latter with appropriate social cover, it seemed appropriate to introduce, for their benefit, a right of option regarding the social security legislation to be applicable to them.
(4) Om gemakkelijker en zonder twijfel de socialezekerheidswetgeving van de lidstaat te kunnen vaststellen waaronder de medewerkers van de leden van het Europees Parlement vallen en om ervoor te zorgen dat deze een passende sociale verzekering krijgen, is het nodig gebleken te hunnen gunste te voorzien in een keuzerecht wat de socialezekerheidswetgeving betreft die op hen van toepassing is.

Whereas the provisions for co-ordination of national social security legislations fall within the framework of freedom of movement for workers who are nationals of Member States and should, to this end, contribute towards the improvement of their standard of living and conditions of employment, by guaranteeing within the Community firstly equality of treatment for all nationals of Member States under the various national legislations and secondly social security benefits for workers and their dependents regardless of their place of employment or of residence;
Overwegende dat de voorschriften ter coördinatie van de nationale wetgevingen inzake sociale zekerheid behoren tot regelingen inzake het vrije verkeer van werknemers die onderdanen van de Lid-Staten zijn, en dat deze voorschriften derhalve moeten bijdragen tot verhoging van de levensstandaard en verbetering van de arbeidsomstandigheden van deze werknemers, door binnen de Gemeenschap te waarborgen dat enerzijds alle onderdanen van de Lid-Staten gelijke behandeling genieten ten opzichte van de verschillende nationale wetgevingen en dat anderzijds de werknemers en hun rechtsopvolgers prestaties inzake sociale zekerheid genieten ongeacht de plaats waar zij werken of wonen;
