Whereas, therefore, this Directive sets out essential requirements only; whereas, in order to facilitate the task of proving compliance with the essential requirements, harmonized European standards are necessary, more especially with regard to the non-electrical aspects of protection against explosions - standards relating to the design, manufacture and testing of equipment, compliance with which enables a product to be presumed to meet such essential requirements; whereas harmonized European standards are drawn up by private bodies and must retain their non-mandatory status; whereas, for this purpose, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as the bodies competent to adopt harmonized standards which follow the general guidelines for cooperation between the Commission and those two bodies, signed on 13 November 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European Standard or harmonization document) adopted by one or other of those bodies, or by both, at the prompting of the Commission pursuant to Council Directive 83/189/EEC of the 28 March 1983 providing for a procedure governing the provision of information on technical standards and regulations (1) and pursuant to the general guidelines referred to above;

Whereas, in order to facilitate proof of conformity with these essential requirements and to permit monitoring of that conformity, it is desirable to have Europe-wide harmonized standards in respect of the prevention of risks in connection with the design, manufacture and packaging of active implantable medical devices; whereas such standards harmonized at European level are drawn up by private-law bodies and must retain their status as non-mandatory texts; whereas, to that end, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as being the competent bodies to adopt harmonized standards in accordance with the general guidelines for cooperation between the Commission and these two bodies, signed on 13 November 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European standard or harmonization document) adopted by either or both of these bodies, as instructed by the Commission pursuant to the provisions of Council Directive 83/189/EEC of 28 March 1983 laying down a procedure for the provision of information in the field of technical standards and regulations (4), as last amended by Directive 88/182/EEC (5), and under the abovementioned general guidelines;

Whereas these essential requirements provide the basis for the preparation of harmonized standards at European level for construction products; whereas, in order to achieve the greatest possible advantage for a single internal market,to afford access to that market for as many mannifacturers as possible, to ensure the greatest possible degree of market transparency and to create the conditions for a harmonized system of general rules in the construction industry, harmonized standards should be established as far as, and as quickly as, possible; whereas these standards are drawn up by private bodies and must remain non-mandatory texts; whereas, for that purpose, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as the competent bodies for the adoption of harmonized standards in accordance with the general guidelines for cooperation between the Commission and those two bodies signed on 13 November 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European standard or harmonized document) adopted by one or both of those bodies upon a mandate given by the Commission in accordance with the provisions of Council Directive 83/189/EEC of 28 March 1983 laying down a procedure for the provision of information in the field of technical standards and regulations (5);
Overwegende dat met deze fundamentele voorschriften de basis wordt gelegd voor de uitwerking van geharmoniseerde normen op Europees niveau voor produkten voor de bouw; dat, om een zo groot mogelijke bijdrage te leveren aan de totstandkoming van de interne markt, zoveel mogelijk fabrikanten toegang tot deze markt te bieden,een zo groot mogelijke marktdoorzichtigheid te waarborgen en de noodzakelijke voorwaarden te scheppen voor een geharmoniseerd Europees bouwvoorschriftenstelsel, voor zover mogelijk ten spoedigste geharmoniseerde normen dienen te worden opgesteld; dat deze normen door particuliere instanties worden opgesteld en dus niet bindende teksten moeten blijven; dat in dit verband de Europese Commissie voor Normalisatie (CEN) en het Europees Comité voor elektrotechnische normalisatie (CENELEC) erkend zijn als de organen die bevoegd zijn om, overeenkomstig de op 13 november 1984 ondertekende algemene richtsnoeren voor de samenwerking tussen de Commissie en deze twee instanties, geharmoniseerde normen aan te nemen; dat voor de toepassing van deze richtlijn een geharmoniseerde norm een technische specificatie (Europese norm of geharmoniseerd document) is die door een van of beide genoemde instanties in opdracht van de Commissie is aangenomen overeenkomstig Richtlijn 83/ 189/EEG van de Raad van 28 maart 1983 betreffende een informatieprocedure op het gebied van normen en technische voorschriften (5);

Whereas this Directive therefore contains only mandatory and essential requirements; whereas, to facilitate proof of conformity with the essential requirements, it is necessary to have harmonized standards at European level in particular as to the design, operation and installation of simple pressure vessels so that products complying with them may be assumed to conform to the safety requirements; whereas these standards harmonized at European level are drawn up by private bodies and must remain non-mandatory texts; whereas for that purpose the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (CENELEC) are recognized as the competent bodies for the adoption of harmonized standards in accordance with the general guidelines for cooperation between the Commission and those two bodies signed on 13 N°vember 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European standard or harmonization document) adopted by one or both of those bodies upon a remit from the Commission in Accordance with the provisions of Council Directive 83/189/EEC of 28 March 1983 laying down a procedure for the provision of information in the field of technical standards and regulations(4) and the abovementioned general guidelines;
Overwegende dat deze richtlijn derhalve uitsluitend de dwingende en essentiële voorschriften bevat; dat het, ten einde het bewijs van overeenstemming met de essentiële voorschriften te vergemakkelijken, onontbeerlijk is om op Europees vlak te beschikken over geharmoniseerde normen inzake met name constructie, werking en installatie van drukvaten van eenvoudige vorm, welker inachtneming de produkten een vermoeden van overeenstemming met de essentiële voorschriften verschaft; dat deze op Europees vlak geharmoniseerde normen worden opgesteld door particuliere instellingen en hun status van niet-bindende teksten moeten behouden; dat in verband hiermede het Europees Comité voor Normalisatie (CEN) en het Europees Comité voor normalisatie op het gebied van elektrotechniek (CENELEC) erkend worden als de instellingen die bevoegd zijn tot goedkeuring van de geharmoniseerde normen overeenkomstig de Algemene richtsnoeren voor samenwerking tussen de Commissie en deze beide instellingen die op 13 november 1984 werden ondertekend; dat in deze richtlijn onder geharmoniseerde norm een technische specificatie (Europese norm of harmoniseringsdocument) wordt verstaan die door een van deze instellingen, of door beiden is aanvaard in opdracht van de Commissie overeenkomstig de bepalingen van Richtlijn 83/189/EEG van de Raad van 28 maart 1983 betreffende een informatieprocedure op het gebied van normen en technische voorschriften(4) alsmede krachtens bovenbedoelde Algemene richtsnoeren;
