In afwijking van punt 1, onder d), mag de exploitant van het levensmiddelenbedrijf afzien van de koeling van de visserijproducten, wanneer visserijproducten in gehele staat direct worden gebruikt voor de bereiding van visolie voor menselijke consumptie en de grondstoffen binnen 36 uur na het laden worden verwerkt, mits aan de versheidscriteria wordt voldaan en de totale vluchtige-basestikstof (TVB-N)-waarde van de onverwerkte visserijproducten de in punt 1 van hoofdstuk I van sectie II van bijlage II bij Verordening (EG) nr. 2074/2005 van de Commissie vastgestelde grenswaarden niet overschrijdt.

However, as stated in recitals (56) and (57) of the abovementioned Council Regulation, the Council considered that Acron should exceptionally be allowed to complete its undertaking offer within 10 calendar days from entry into force of that Regulation due to the complexity of several issues, namely (1) the volatility of the price of the product concerned which would require some form of indexation of minimum prices, while at the same time the volatility is not sufficiently explained by the key cost driver; and (2) the particular market situation for the product concerned.

Furthermore EU-wide regulations to reduce VOCs (Directive 94/63/EC on the control of volatile organic compound emissions resulting from the storage of petrol and its distribution from terminals to service stations(4); Directive 1999/13/EC on the limitation of emissions of volatile organic compounds due to the use of organic solvents in certain activities and installations(5); Directive 96/61/EC concerning integrated pollution prevention and control(6)) as well as pending strategies to regulate the VOC content in products will reduce ozone peak levels.
