La réserve prévue était formulée littéralement comme suit : « Contracting States may reserve the right not to return the child when such return would be manifestly incompatible with the fundamental principles of the law relating to the family and children in the State addressed » (15) En adoptant ce texte, on ouvrait une brèche grave dans le consensus qui avait présidé fondamentalement jusqu'alors aux travaux de la Conférence; c'est pourquoi, conscientes de ce qu'il fallait trouver une solution largement acceptable, toutes les délégations se sont engagées dans cette voie qui constituait le chemin le plus sûr pour garantir la réussite de la Convention.

De problemen met de botscan: - bij onderschepping moet de politie te lang wachten op een antwoord van de DVZ en de dienst Voogdij; - veel discussies tussen de dienst Voogdij en de DVZ over de minderjarigheid van bepaalde personen; - de aangedragen info door de DVZ wordt niet meegenomen in de identificatiebeslissing van de dienst Voogdij; - heropenen van een dossier door de dienst Voogdij is heel moeilijk ook als er objectieve elementen door de DVZ worden aangereikt; - de beslissingstermijn is veel te lang, probleem bij Dublin-dossiers, tijd voor overname is verstreken en dus dient het asieldossier van de meerderjarige persoon alsnog in België behandeld te worden; - problemen voor de NBMV: incoherentie tussen rijksregister en identificatie van de dienst Voogdij: problemen bij inschrijving school, openen bankrekening, enzovoort Uit het rapport van het Europees Migratienetwerk (EMN) "Policies, practices and data on unaccompanied minors in the EU Member States and Norway, Synthesis Report, May 2015" worden er bepaalde good practices van België beschreven met betrekking tot NBMV.
