En 1991, l'Assemblée parlementaire du Conseil de l'Europe a adopté une recommandation, à savoir la Recommendation 1159 (1991) on the harmonisation of autopsy rules, sur la base de laquelle le Conseil des ministres de ce même Conseil a adopté une recommandation plus étendue, à savoir la Recommendation nº R (99) 3 of the Committe of ministers to member states on the harmonisation of medico-legal autopsy rules (adoptée le 2 février 1999).

Contrairement au point 1 de l'avis 35.970/4 du Conseil d'État, les « rules of procedure for the arbitration regarding the « IJzeren Rijn » between the Kingdom of Belgium and the Kingdom of The Netherland » ne constituent pas un traité au sens du droit international et partant, au sens de l'article 167, § 2, de la Constitution.
