De toepassing van deze richtlijn mag geen afbreuk doen aan de rechten en beginselen zoals vervat in het Europees Sociaal Handvest van 18 oktober 1961 en het Europees Verdrag inzake de rechtspositie van migrerende werknemers van 24 november 1977.

4. wijst op de toegevoegde waarde van de vijf protocollen bij het EVRM ten aanzien van de handhaving en bescherming van bepaalde rechten en vrijheden binnen en buiten de werkingssfeer van het Verdrag en de verlening van de bevoegdheid aan het Europees Hof voor de Rechten van de Mens om advies uit te brengen; is van mening dat de EU behalve tot het EVRM tevens tot de Protocollen bij het EVRM alsook tot het Europees Sociaal Handvest van 1961 en het herziene Sociaal Handvest zou moeten toetreden; verzoekt, onverminderd artikel 2 van Protocol nr. 8 bij het Verdrag van Lissabon, de lidstaten die dit nog niet hebben gedaan, de verschillende aanvullende Protocollen van het EVRM zo spoedig mogelijk te ondertekenen en te ratificeren aangezien zij voortdurend verklaren dat zij hechten aan de waarden en beginselen waarop de democratie en de rechtstaat binnen onze lidstaten en de Europese Unie zijn gebaseerd;

Points out the added value of the Five Protocols to the ECHR in terms of enforcing and protecting certain rights and freedoms within and outside the scope of the Convention and conferring upon the European Court of Human Rights the competence to give advisory opinions; is of the opinion that, when the EU accedes to the ECHR, it should also accede to the Protocols to the Convention, as well as to the European Social Charter of 1961 and the revised Social Charter; notwithstanding Article 2 of Protocol No 8 to the Lisbon Treaty, asks the Member States that have not yet done so to sign and ratify the various ECHR supplementary protocols as soon as possible, in view of their repeatedly voiced commitment to the values and principles underlying democracy and the rule of law in our Member States and the European Union;
