(1) Whereas several distinct transmissible spongiform encephalopathies (TSEs) have been recognised for many years as occurring separately in humans and animals; whereas bovine spongiform encephalopathy (BSE) was first recognised in cattle in 1986 and in following years was recognised as occurring in other species of animals; whereas a new variant of Creutzfeldt-Jakob Disease (nv-CJD) was described in 1996; whereas evidence is accumulating that the agent causing BSE is identical to that causing nv-CJD;

(1) Overwegende dat in het Verenigd Koninkrijk nieuwe informatie is bekendgemaakt die bijkomende steun biedt voor de hypothese dat er tussen blootstelling aan het agens van boviene spongiforme encefalopathie (BSE) en de nieuwe variant van de ziekte van Creutzfeldt-Jakob bij de mens een verband bestaat; dat het Raadgevend comité inzake spongiforme encefalopathieën ("Spongiform Encephalopathy Advisory Committee" (SEAC)) van het Verenigd Koninkrijk op 16 september 1997 tot de bevinding is gekomen dat recent onderzoek nieuwe bewijzen heeft opgeleverd waaruit onomstotelijk blijkt dat het oorzakelijke agens van BSE identiek is aan het oorzakelijke agens van de nieuwe variant van de ziekte van Creutzfeldt-Jakob bij de mens; dat het Raadgevend comité inzake gevaarlijke pathogenen ("Advisory Committee on Dangerous Pathogens" (ACDP)) op 18 september 1997 heeft geconcludeerd dat het agens van BSE voortaan als voor de mens pathogeen moet worden aangemerkt;
(1) Whereas new information has been published in the United Kingdom further supporting the hypothesis that exposure to the bovine spongiform encephalopathy (BSE) agent is linked to the new variant of Creutzfeldt Jacob Disease (CJD) in humans; whereas on 16 September 1997 the Spongiform Encephalopathy Advisory Committee (SEAC) of the United Kingdom concluded that recent research provided compelling new evidence that the agent which causes BSE is identical to the agent which causes the new variant of CJD in humans; whereas on 18 September 1997 the Advisory Committee on Dangerous Pathogens (ACDP) concluded that the BSE agent should now be classified as a human pathogen;

(2) Overwegende dat in de periode van 1 januari 1998 tot en met 14 oktober 1998 in Portugal 66 gevallen van BSE zijn gemeld; dat dit voor de laatste twaalf maanden een BSE-incidentie van 105,6 gevallen per miljoen dieren van meer dan twee jaar oplevert; dat twee gevallen zijn geconstateerd bij dieren die zijn geboren na de tenuitvoerlegging van het verbod op het vervoederen van van zoogdieren afkomstig eiwit aan herkauwers; dat de ontwikkeling van de incidentie van de ziekte erop wijst dat er zich een potentiële recyclering en accumulering van het BSE-agens in de rundveepopulatie in Portugal voordoet;
(2) Whereas 66 cases of BSE have been notified in Portugal between 1 January 1998 and 14 October 1998; whereas this leads to a BSE incidence rate calculated over the past 12 months of 105,6 cases per million animals over two years of age; whereas two cases have been identified in animals born after implementation of the prohibition on feeding mammalian derived protein to ruminants; whereas the development of the incidence of the disease indicates potential recycling and accumulation of the BSE agent in the Portuguese cattle population;

Inmiddels heeft de Commissie de uitvoering van het besluit van Florence praktisch onderbroken. Zij motiveert dit met "later beschikbaar gekomen informatie waaruit blijkt dat inactivering van het BSE-agens in het productieproces niet kan worden gewaarborgd" (Eerste voortgangsverslag blz. 38).
In the meantime, the Commission has in effect suspended implementation of the Florence decision in the light of 'later information that inactivation of the BSE agent could not be guaranteed in the production process' (First Progress Report, p. 39 of the English version), and this is to be welcomed.

(c) In juni 1987 waren de Britse ministers reeds op de hoogte van het bestaan van BSE, maar omdat de wetenschappers er niet in slaagden vast te stellen of het BSE-agens op andere diersoorten of op mensen overgedragen kon worden, besloten zij niets te doen tot 18 juli 1988, toen het embargo op veevoeder van kracht werd (dat niet gold voor de bestaande voorraden).
(c) In June 1987, British ministers were already aware of the existence of BSE and of the fact that scientists could not determine whether it could or could not be transmitted to other species or to humans. However, they decided to do nothing until 18 July 1988 when the ban on cattle feed was applied (this ban did not affect existing stocks).

The consistent application and the monitoring of a single procedure for the inactivation of the BSE agent, not only as from 1 April 1997 but considerably earlier - Parliament had already called for the application of this procedure in 1993 in the Garcia report - would have substantially reduced the spread of BSE and would not have raised health doubts concerning the processing of animal waste to form meat-and-bone meal for use as feedingstuffs.
