– having regard to the statement by the spokesperson for the Office of the High Commissioner for Human Rights (OHCHR) of 18 January 2013 on recent attacks on human rights defenders ahead of elections,

– gezien de verklaring van 27 september 2013 van de woordvoerder van het VN-Bureau van de hoge commissaris voor de mensenrechten, waarin wordt opgeroepen tot terughoudendheid nu het dodental bij de brandstofonlusten in Sudan oploopt,
– having regard to the statement of 27 September 2013 by the Spokesperson for the Office of the UN High Commissioner for Human Rights, urging restraint as death toll in Sudan fuel protests rises,

143 Volgens verzoeker zijn er in het onderhavige geval objectieve, ter zake dienende en onderling overeenstemmende aanwijzingen dat het bureau de procedure om zuiver politieke redenen en onder druk van de woordvoerders van twee Spaanse politieke groeperingen heeft ingeleid. Volgens hem hebben laatstgenoemden aan de drie Spaanse ondervoorzitters gevraagd om binnen het bureau hun invloed tegen hem aan te wenden.

According to the applicant, in the present case there are objective, relevant and consistent factors to indicate that the procedure was initiated by the Bureau for purely political reasons under pressure from the spokesmen of two Spanish political groups, which allegedly asked the three Spanish Vice-Presidents to take action within the Bureau against the applicant.

105 Verzoeker betoogt in de tweede plaats dat het geschil deel uitmaakt van een campagne die tot doel heeft de politieke activiteit van de voorstanders van Baskische onafhankelijkheid en met name de EH/B te criminaliseren.
