TRADUCTIONS EN CONTEXTE

E. het Constitutioneel Verdrag dat door alle staatshoofden en regeringsleiders is ondertekend, aan het Parlement het recht verleend om de delegatie van bevoegdheden in te trekken (artikel I-36); dat de definitieve compromistekst van een nieuwe regelgevingsprocedure met toetsing niet in een dergelijk recht voor het Parlement voorziet; dat het recht om een delegatie van bevoegdheden in te trekken derhalve een fundamenteel verzoek van het Europees Parlement blijft, dat met name via het Constitutioneel Verdrag kan worden ingewilligd;
E. the Constitutional Treaty signed by all Heads of Government and State grants Parliament the right to revoke the delegation of powers (Article I - 36). The final compromise text for a new regulatory procedure with scrutiny does not provide for such a right for the Parliament. The right to revoke a delegation of powers will therefore remain a key demand of the European Parliament which could be achieved notably by the Constitutional Treaty,

1. waarschuwt ertegen om in afwachting van de ratificatie van het Constitutioneel verdrag de nieuwe Verdragsbepalingen geheel of gedeeltelijk goed te keuren vanwege de constitutionele ambitie van het Verdrag en het feit dat dit zou kunnen worden opgevat als een poging om de wens van de bevolking te omzeilen in die landen die het Constitutioneel verdrag nog niet hebben geratificeerd;
1. Pending the ratification of the Constitutional Treaty, warns against any total or partial endorsement of the new Treaty provisions given its constitutional ambition and the fact that this could be perceived as an attempt to circumvent citizens' wishes in the countries which have not yet ratified the Constitutional Treaty;

23. Recommends that the provisions of the Constitutional Treaty be followed by steadily progressing the preparatory work for the new Service, whilst providing for its effective creation only following ratification of the Constitutional Treaty.

3. Regrets that the ratification process has foundered in two Member States; supports, however, the view that the ratification process should continue at the pace decided on by each Member State and that the Constitutional Treaty can be applied as a whole only if and when the ratification is completed in accordance with the new Treaty; recommends to take advantage of the reflection period to respond without delay to the matters which appear to be at the root of the failure of the ratification process in two Member States and to fill the current gap between citizens wishes and the European integration process in order that the progress towards a constitutional Europe may resume;

2. betreurt in dit verband buitengewoon dat zaken die tot dusver onder de raadplegingsprocedure vielen, met name de vaststelling van quota, prijzen en kwantitatieve beperkingen in artikel III-231, lid 3, thans alleen door de Raad zonder deelname van het Parlement worden besloten; acht dit contraproductief gelet op de overigens in het constitutioneel verdrag waarneembare tendens tot opheffing van het democratisch tekort; wijst de Raad er in dit verband op dat het in het kader van zijn wetgevende bevoegdheid de voorwaarden voor de regeling van de in artikel III-231, lid 3 genoemde gebieden inhoudelijk zoveel mogelijk zal vastleggen; herhaalt zijn eis dat aangelegenheden die tot dusver onder de raadpleging vielen, maar door het constitutioneel verdrag, in de bepalingen over het landbouwbeleid, in het bijzonder in artikel III-231, lid 3, als bij verordening resp. besluit van de Raad te regelen materie worden behandeld, in de toekomst alleen onder de uitvoeringsbevoegdheid van de Commissie mogen vallen wanneer die bevoegdheid haar tevoren door het Parlement en de Raad bij een volgens de medebeslissingsprocedure aangenomen rechtshandeling is overgedragen;
2. Regrets greatly in this regard that, under Article III-231(3), the matters previously subject to consultation, particularly the setting of quotas, prices and quantitative restrictions, are now to be decided by the Council alone, without Parliament's involvement; considers this to be counterproductive in view of the draft Constitution's otherwise visible tendency towards reducing the democratic deficit; reminds the Council that it will make use of its legislative powers to determine as far as possible the content of the conditions for regulating the matters referred to under Article III-231(3); repeats its demand that matters that have hitherto been subject to the consultation procedure and are considered under the section of the draft Constitution on agriculture, in particular Article III-231(3), to require a Council regulation or decision should in future only fall within the implementing power of the Commission if this is conferred upon it beforehand by Parliament and the Council by means of an act adopted under the codecision procedure;

De Conferentie moet zo spoedig mogelijk en op tijd om vóór de verkiezingen van het Europees Parlement in juni 2004 aan het constitutioneel verdrag bij de Europese burgers de nodige bekendheid te kunnen geven, haar werkzaamheden voltooien en het constitutioneel verdrag goedkeuren.
