Uit punt 1 van de eerste groep van toelatingsvoorwaarden in de kennisgeving van vacature blijkt immers dat, overeenkomstig artikel 98 van het Statuut, de kandidaten ofwel ambtenaar moesten zijn van het secretariaat-generaal van de Raad van de Europese Unie, ofwel ambtenaar van de Commissie of de EDEO, ofwel tijdelijk personeelslid waarop artikel 2, onder e), RAP van toepassing is, te weten lid van het personeel dat vanuit de nationale diplomatieke dienst van een van de lidstaten wordt aangesteld om tijdelijk een vast ambt bij de EDEO te vervullen, ofwel een lid van het personeel van de nationale diplomatieke dienst van een van de lidstaten.
It is clear from paragraph 1 of the first group of eligibility criteria contained in the vacancy notice that, according to Article 98 of the Staff Regulations, candidates must be officials of the General Secretariat of the Council of the European Union, of the Commission or of the EEAS, or temporary staff to whom Article 2(e) of the CEOS applies, that is to say, staff seconded from the national diplomatic services of the Member States engaged in order to occupy temporarily a permanent post within the EEAS, or staff from the national diplomatic services of the Member States.

Hieruit volgt dat, gelet op het niveau van hogere opleiding dat door de kennisgeving van vacature werd vereist voor kandidaten die lid waren van de nationale diplomatieke dienst van een van de lidstaten, te weten het niveau dat is vastgelegd in artikel 5, lid 3, onder b), i), van het Statuut voor een aanstelling in de rangen 5 en 6 van de functiegroep AD, en gelet op het minimaal vereiste aantal jaren beroepservaring, dat slechts twee jaar bedroeg, de kandidaten die lid waren van het personeel van de nationale diplomatieke dienst van een van de lidstaten, waartoe ook verzoeker behoorde, zich niet konden vergissen over de rang die was voorzien voor de te vervullen post.
It follows that, in view of the level of higher education required by the vacancy notice in the case of candidates who are staff from the national diplomatic services of the Member States, namely that provided for in Article 5(3)(b)(i) of the Staff Regulations for appointment to grades 5 and 6 in function group AD, and the number of years’ minimum professional experience required, which was only two, candidates who were staff from the national diplomatic services of the Member States, which included the applicant, could not be misled with regard to the grade that corresponded to the vacant post.

13. neemt kennis van het feit dat de tot dusver in de lidstaten gebruikte financieringsmodellen voor de universele dienst weinig succesvol waren en dat het beproefde financieringsinstrument voor de universele dienst tot dusverre de voorbehouden sector was; verzoekt de Commissie derhalve in de op te stellen verkennende studie grondig te laten onderzoeken, in hoeverre de ontwikkeling van de universele dienst, waarvan het behoud op economisch en sociaal vlak relevant blijft, en een mogelijke flexibilisering van het regelgevingskader positief kan zijn voor het oplossen van het financieringsprobleem bij de universele dienst; verzoekt de Commissie te laten onderzoeken of een aanpassing van de voorbehouden sector mogelijk is afhankelijk van de kosten die zijn verbonden aan de financiering van de universele dienst met name in het licht van de geografische en demografische beperkingen;

Notes that the funding models for universal service used so far in the Member States have not been very successful and that the tried and tested funding instrument for universal services in the past has been the reserved sector; calls therefore on the Commission to look in detail, in its forthcoming prospective study, at whether the development of the universal service, the retention of which remains relevant in economic and social terms, and a greater flexibility for the regulatory framework can have a positive influence on resolving the problem of funding universal services; calls on the Commission to examine the possibility of differentiating the reserved sector depending on the costs associated with funding the universal service, particularly in view of geographic and demographic constraints;

Op basis hiervan heeft de Raad in zijn conclusies van 6 december 2002 bepaald dat de aanbestedingen die in het kader van het Galileo-programma zullen plaatsvinden, met name die van de concessie, op vijf diensten betrekking dienen te hebben: een "open dienst", een "commerciële dienst", een "safety-of-life-dienst", een "beveiligde gouvernementele dienst" (PRS) en de ondersteuning van de opsporings- en reddingsdienst COSPAS-SARSAT of andere relevante systemen.
