TRADUCTIONS EN CONTEXTE

7. is verontrust over het feit dat verschillende nationale interpretaties van de Europese douanewetgeving administratieve rompslomp voor het bedrijfsleven met zich meebrengen met alle negatieve gevolgen van dien voor het Europese concurrentievermogen, en tot een verzwakking leiden van het vermogen van de EU om een efficiënte, op risico's gebaseerde benadering van naleving toe te passen; verzoekt de lidstaten daarom zich volledig toe te leggen op het proces van modernisering van de douane, en dan met name op de uniforme toepassing van de douanewetgeving van de EU; dringt er bovendien op aan dat de Commissie onverwijld alle nodige stappen zet om te zorgen voor een consequente en geharmoniseerde toepassing van de Europese douanewetgeving in de hele EU;
7. Is concerned that different national interpretations of the EU customs legislation create red tape for business, with a consequential negative impact on European competitiveness, and weaken the EU’s ability to administer an efficient risk-based approach to compliance; therefore calls on the Member States to commit fully to the process of modernisation of customs and especially to the uniform application of EU customs legislation; insists moreover that the Commission, without delay, takes all necessary actions to ensure a seamless and harmonised application of the EU customs legislation throughout the EU;

In mijn visie kan verdere harmonisatie van de toepassing van douanewetgeving worden bereikt door middel van de volgende initiatieven: de huidige werkzaamheden op het gebied van de toepassing van het gemoderniseerd douanewetboek en het besluit over de e-douane, een nieuw programma voor gerichte controle op de correcte en uniforme toepassing van de douanewetgeving, en een beoordeling, samen met de lidstaten, van de noodzaak van en de mogelijkheden voor het opleggen van straffen op het overtreden van de douanewetgeving.
In my view, further harmonisation in implementing customs legislation can be achieved through the following initiatives: the current work on the implementation of the modernised Customs Code and the e-Customs Decision; a new programme for targeted monitoring of the correct and uniform application of customs legislation, and an assessment, in partnership with the Member States, of the needs and possibilities to approximate customs offences and penalties.

21. doet een beroep op de lidstaten om op synchrone en geharmoniseerde wijze nieuwe werkmethoden en technieken uit te werken, en te zorgen voor een gecoördineerde en gemeenschappelijke tenuitvoerlegging van de douanewetgeving; verzoekt de Commissie om de uniforme toepassing van de douanewetgeving in de lidstaten goed in het oog te houden en hierover aan het Parlement verslag uit te brengen;

Calls on the Member States to develop new working methods and technology in a synchronised and harmonised way and to ensure a coordinated and common implementation of customs legislation; calls on the Commission to monitor closely the uniform application of customs legislation in the Member States and to report back to Parliament;

1. All exchanges of data, accompanying documents, decisions and notifications between customs authorities and between economic operators and customs authorities required under the customs legislation, and the storage of such data as required under the customs legislation, shall be made using electronic data-processing techniques.

„douaneautoriteiten”: de douanediensten van de lidstaten die bevoegd zijn voor de toepassing van de douanewetgeving, en alle overige autoriteiten die krachtens het nationale recht belast zijn met de toepassing van bepaalde onderdelen van de douanewetgeving;
‘customs authorities’ means the customs administrations of the Member States responsible for applying the customs legislation and any other authorities empowered under national law to apply certain customs legislation;

Het is derhalve passend om, in overeenstemming met de mededeling van de Commissie betreffende eenvoudige en papierloze procedures voor de douanediensten en het bedrijfsleven, de douanewetgeving te vereenvoudigen en het gebruik van moderne instrumenten en technologieën toe te staan, teneinde de uniforme toepassing van de douanewetgeving en modernisering van de douanecontrole verder te bevorderen, waardoor mede de basis wordt gelegd voor efficiënte en eenvoudige douaneprocedures.
It is therefore appropriate, in line with the Communication from the Commission on a simple and paperless environment for customs and trade, to simplify customs legislation, to allow the use of modern tools and technology and to promote further the uniform application of customs legislation and modernised approaches to customs control, thus helping to ensure the basis for efficient and simple clearance procedures.

Dit instrument sluit tevens aan bij de douanewetgeving waarop ze een aanvulling kan vormen wat betreft de raakvlakken tussen de bevoorradingsketen en de douanewetgeving.
It is in line with the custom legislation which it could complement where the supply chain meets customs requirements.
