The President of the Court of Justice may, by way of summary procedure, which may, in so far as necessary, differ from some of the rules contained in this Statute and which shall be laid down in the Rules of Procedure, adjudicate upon applications to suspend execution, as provided for in Article 278 of the Treaty on the Functioning of the European Union and Article 157 of the EAEC Treaty, or to prescribe interim measures pursuant to Article 279 of the Treaty on the Functioning of the European Union, or to suspend enforcement in accordance with the fourth paragraph of Article 299 of the Treaty on the Functioning of the European Union or the third paragraph of Article 164 of the EAEC Treaty.

OVERWEGENDE dat krachtens de bepalingen van artikel 343 van het Verdrag betreffende de werking van de Europese Unie en naar artikel 191 van het Verdrag tot oprichting van de Europese Gemeenschap voor Atoomenergie (EGA), de Europese Unie en de EGA op het grondgebied van de lidstaten de immuniteiten en voorrechten genieten welke nodig zijn ter vervulling van hun taak,
CONSIDERING that, in accordance with Article 343 of the Treaty on the Functioning of the European Union and Article 191 of the Treaty establishing the European Atomic Energy Community ("EAEC"), the European Union and the EAEC shall enjoy in the territories of the Member States such privileges and immunities as are necessary for the performance of their tasks,

Takes note of the recent case-law to the effect that the EAEC Treaty "is not applicable to uses of nuclear energy for military purposes"; however, considers that the Court of Justice clearly linked its restrictive interpretation of the scope of the EAEC Treaty with the need to protect the essential national defence interests of the Member States;

Without prejudice to the auditing of the accounts and to checks that they are lawful and regular as laid down in Article 248 of the Treaty establishing the European Community and Article 160c of the Euratom Treaty, such auditing and checks being concerned in particular with the reliability and effectiveness of national systems and procedures for determining the base for own resources accruing from VAT and GNP, and without prejudice to the inspection arrangements made pursuant to Article 279(c) of the EC Treaty and Article 183(c) of the Euratom Treaty, the Council shall, acting unanimously on a proposal from the Commission and after consulting the European Parliament, adopt the provisions necessary to apply this Decision and to make possible the inspection of the collection, the making available to the Commission and payment of the revenue referred to in Articles 2 and 5.

F. whereas Parliament's repeated calls for the Euratom Treaty to be revised to provide for parliamentary consultation have been ignored, as have been its requests to be consulted on all international agreements and other general acts based on the Euratom Treaty even in the absence of a formal obligation to do so,
