In order to ensure uniform conditions for the implementation of this Regulation implementing powers should be conferred on the Commission with respect to: listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into the Union territory; listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into certain protected zones from those third countries; listing of the plants, plant products and other objects, the third countries concerned, and the maximum quantity subject to be exempted from the requirement for a phytosanitary certificate when introduced in the Union territory; and setting out technical arrangements concerning the invalidation of the electronic phytosanitary certificates.

1. Wanneer voor de uitvoer van planten, plantaardige producten of andere materialen uit het grondgebied van de Unie naar een derde land volgens de fytosanitaire invoervoorschriften van dat derde land een fytosanitair certificaat („fytosanitair uitvoercertificaat”) vereist is, wordt dat certificaat afgegeven door de bevoegde autoriteit, op verzoek van de professionele marktdeelnemer, indien is voldaan aan alle volgende voorwaarden:

Where, for the export of a plant, plant product or other object from the Union territory to a third country, a phytosanitary certificate is required by the phytosanitary import requirements of that third country (‘phytosanitary certificate for export’), that certificate shall be issued by the competent authority, at the request of the professional operator, when all of the following conditions are fulfilled:

Calls for agricultural imports into the EU to provide European consumers with the same guarantees in terms of consumer protection, animal welfare, environmental protection and minimum social standards as those provided by European production methods, and draws attention to Parliament’s firm position on this matter; calls on the Commission to include clauses in bilateral trade agreements that oblige third countries to comply with the same sanitary and phytosanitary conditions that are imposed on European producers; considers that such agreements must provide at least for compliance with international obligations and standards;

Volgens de in lid 1, eerste alinea, bedoelde procedures worden fytosanitaire maatregelen die door een derde land worden genomen ten aanzien van de uitvoer naar de Gemeenschap, erkend als gelijkwaardig aan de in deze richtlijn vastgestelde fytosanitaire maatregelen, en met name aan de in bijlage IV vermelde maatregelen, indien dat derde land de Gemeenschap op objectieve wijze bewijst dat met de maatregelen die het toepast het adequate fytosanitaire beschermingsniveau van de Gemeenschap wordt bereikt, en indien dit wordt bevestigd door de conclusies van controles, tests en andere procedures die door de in artikel 21 bedoelde deskundigen onder redelijke voorwaarden inzake toegang in het betrokken derde land zijn afgewikkeld.
In accordance with the procedures referred to in the first subparagraph of paragraph 1, phytosanitary measures adopted by a third country for export into the Community shall be recognised as equivalent to the phytosanitary measures laid down in this Directive, in particular to those specified in Annex IV, if that third country objectively demonstrates to the Community that its measures achieve the Community's appropriate level of phytosanitary protection and if this is confirmed by the conclusions resulting from findings made on the occasion of reasonable access of the experts referred to in Article 21 for inspection, testing and other relevant procedures in the relevant third country.

(1) In Richtlijn 2000/29/EG van de Raad van 8 mei 2000 betreffende de beschermende maatregelen tegen het binnenbrengen en de verspreiding in de Gemeenschap van voor planten en voor plantaardige producten schadelijke organismen(4) is de communautaire regeling op fytosanitair gebied vastgesteld, waarin de voorwaarden, procedures en formaliteiten zijn opgenomen die in fytosanitair opzicht gelden voor het binnenbrengen in en het verkeer binnen de Gemeenschap van planten en plantaardige producten.
(1) Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community(4) sets out the Community plant health regime, specifying the phytosanitary conditions, procedures and formalities to which plants and plant products are subjected when introduced into, or moved within, the Community.

(13) Op grond van artikel 4 van de Overeenkomst inzake sanitaire en fytosanitaire maatregelen (de SPS-overeenkomst), moet de Gemeenschap onder bepaalde voorwaarden erkennen dat de fytosanitaire maatregelen van andere partijen bij die overeenkomst gelijkwaardig zijn aan haar eigen maatregelen.
(13) Under Article 4 of the Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement), the Community must recognise, under certain conditions, the equivalence of phytosanitary measures of other Parties to that Agreement.
